Memorandum
Attached for your review and action is a resolution to approve a contract with J.W. Field Grading and Excavating, LLC. in the amount of $36,820.00, per bid #4040. The project includes replacement of a deteriorated walk and installation of an adjacent rain garden basin.
The walk traverses Buhr Park from Essex Street to Allen School and serves as the primary access to the school for the adjacent neighborhood. The improvements will also include grading to make the path barrier free.
The rain garden feature is part of the Buhr Park Stormwater Master Plan, developed in 2000 and being implemented over time as projects such as this one are funded.
Bids were advertised on the City's website and on BidNET and sent to qualified contractors. Six companies submitted bids for the project as follows:

J.W. Field Grading and Excavating, LLC received Human Rights Approval on July 23, 2009. The contractor complies with the living and prevailing wage ordinance.
Funding for the project is included in the approved FY 2010 Park Rehabilitation and Development Millage budget.

Whereas, Renovations to Buhr Park are scheduled in the Park and Recreation Open Space Plan, 2006-2011;
Whereas, The path between Essex Street and Allen School is severely deteriorated, and needs to be replaced;
Whereas, This project includes a rain garden feature that was part of the Stormwater Master Plan for Buhr Park, developed in 2000;
Whereas, Competitive bids were sought by the Procurement Division for Buhr Park Pathway with bids received on July 14, 2009 and J.W. Field Grading and Excavating, LLC was identified as the lowest responsible bidder;
Whereas, Funds for the project is included in the FY 2010 approved Park Rehabilitation and Development Millage budget; and
Whereas, J.W. Field Grading and Excavating, LLC received Human Rights approval on July 23, 2009 and complies with the living wage and prevailing wage requirements;
RESOLVED, That City Council approve the contract with J.W. Field Grading and Excavating, LLC, per bid #4040 in the amount of $36,820.00 and a construction contingency in the amount of $3,682.00 (10%) to cover potential contract change orders, for a total construction budget of $40,502.00 for the life of the project without regard to fiscal year;
RESOLVED, That the City Administrator is authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
