Memorandum
Attached for your review and approval is a resolution to authorize an Agreement with the University of Michigan to construct the Harvard Drain & Nichols Arboretum Improvements Project.
 
The existing storm pipe in Harvard Place, Highland Road and Ridgeway Street currently is undersized, and consequently the pipe surcharges, causing flooding in Harvard Place.  The pipe outlets into the Nichols Arboretum where the water has been causing erosion on both city residents' and University property.  To alleviate this condition, the City and the University of Michigan have been cooperating on design and engineering improvements on city right-of-way and University property.
 
To reduce flooding, increase capacity of the pipe, and slow the storm water velocity before it outlets, the improvements in the city right-of-way include replacing the existing 15 and 12 inch storm sewer with new drop structures, pipe upsizing to 12 and 27 inches in diameter, and pipe slope modifications.  
 
In the Arboretum, improvements include the construction of an infiltration meadow area with stone step-pool structures and drainage channel restoration to promote infiltration of the water into the sandy soils.
 
The Agreement submitted with this resolution has been reviewed and approved by the University of Michigan.

Whereas, It is beneficial to the environment and the community to improve the storm system to reduce stormwater velocities, reduce erosion and sedimentation, and promote infiltration to replenish groundwater;
 
Whereas, The stormwater from Harvard Place, Highland Road and Ridgeway Street outlet into the Nichols Arboretum;
 
Whereas, The City and the University have cooperated on the planning and engineering of the Project;
 
Whereas, The City and the University have reached an agreement regarding the performance of and payment for the Project;
 
Whereas, The City of Ann Arbor has completed the project design and has let the construction contract for bids;
 
Whereas, The total construction cost for the project is $160,579.50.  Funding for the City share of this project, $94,699.50, will be advanced from the Approved Storm Water Capital budget.  Funding for $65,880 of this project will be paid for by the University of Michigan as stated in the agreement; and
 
Whereas, The City of Ann Arbor will administer the construction contract for all the improvements and pay for the items benefiting the City;
 
RESOLVED, That the City enter into the attached agreement with the University of Michigan for the construction of the Harvard Drain & Nichols Arboretum Improvements Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement, after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
