Whereas, The parties in the above-referenced lawsuit engaged in facilitative mediation on March 12, 2020; and
Whereas, The City Attorney’s Office updated Council regarding the mediation and provided its legal analysis of the case in a privileged and confidential memorandum dated March 31, 2020.
RESOLVED, That the City Council approves and authorizes the settlement of City of Ann Arbor v. NuView Systems, Inc., USDC Case No. 19-cv-13573, for a payment of $150,000.00 from NuView Systems, Inc. to the City contingent upon receipt of a settlement agreement and mutual releases of all claims, and dismissals of all claims with prejudice by the Court, in a form and with terms approved by the City Attorney; and
RESOLVED, That the City Council authorizes and directs the Mayor, Clerk, Interim City Administrator, and City Attorney to take such further actions as are consistent with the purposes of this resolution.
