Resolution to Approve a Contract with Kennedy Industries, Inc. to Remove, Refurbish, and Install a Vertical Turbine Pump at the Wastewater Treatment Plant, ITB No. 4604 ($28,590.00)
Memorandum
Your approval is requested for authorizing a contract with Kennedy Industries, Inc. in the amount of $28,590.00 to remove, refurbish, and install a vertical turbine pump in the Tertiary Filter Building at the City’s Wastewater Treatment Plant (WWTP).
The WWTP has six 150 horsepower vertical turbine pumps used to continuously pump secondary effluent into sand filters that comprise the plant’s tertiary treatment process. Occasionally, when the Huron River is at high levels, additional pumps are used to pump secondary effluent simultaneously to the sand filters and the river. Without sufficient secondary effluent pumping capacity, the WWTP would have to bypass tertiary treatment, risk discharging partially treated sewage into the Huron River or flood the treatment plant. Any such occurrence would be a violation of the WWTP’s discharge permit and expose the City to potential fines of up to $25,000.00 per day per violation from the Michigan Department of Environment, Great Lakes and Energy.
The vertical turbine pump was taken out of service when it was found to be vibrating significantly and not pumping water. WWTP staff emptied the wet well and made confined space entry to inspect the pump. Upon inspection, staff determined that the repairs required removal and refurbishing of the pump.
ITB No. 4604 was advertised by the City’s Purchasing Department and the following three bids were received and publicly opened on November 14, 2019:
• Kennedy Industries Inc. $28,590.00
• KSB Dubric $29,986.00
• T.H. Eiffert $38,600.00
Staff reviewed the bids and recommends that Kennedy Industries, Inc. be approved as the lowest responsible bidder to perform the scope of work detailed in ITB No. 4604. In addition, WWTP staff is requesting a contingency of $2,859.00 to fund any other unforeseeable repairs that are discovered to be necessary upon removal and disassembly of the pump.
Kennedy Industries, Inc. complies with the City’s Non-Discrimination, Conflict of Interest, and Living Wage ordinances.
Budget/Fiscal Impact: Funds to finance this contract are included in the approved FY20 WWTP Operation and Maintenance Budget for the Sewage Disposal System.

Whereas, Three competitive bids were received in response to ITB No. 4604 on November 14, 2019, and WWTP staff recommends Kennedy Industries, Inc. be approved as the lowest responsible bidder to perform this work based on review of the bids;
Whereas, Sufficient funds have been budgeted in the approved FY20 WWTP Operations and Maintenance Budget for the Sewage Disposal System; and
Whereas, Kennedy Industries, Inc. complies with the requirements of the City’s Non-Discrimination, Conflict of Interest, and Living Wage ordinance.
Resolved, That City Council approve a contract with Kennedy Industries, Inc. in the amount of $28,590.00 to perform the services as specified in ITB No. 4604, and a contingency of $2,859.00 to fund any other necessary additional repairs approved by the City Administrator for a total not-to-exceed $31,449.00;
RESOLVED, That the City Administrator be authorized and directed to execute the contract with Kennedy Industries, Inc. subject to approval by the City Administrator as to substance and subject to approval by the City Attorney as to form; and
RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution.
