Resolution Authorizing the Appropriation of $160,771.00 from the General Fund to Reimburse the Street, Bridge, Sidewalk Millage Fund for the Northside STEAM Safe Routes Sidewalk Gap Project (8 Votes Required)

Memorandum

This resolution seeks authorization to appropriate $160,771.00 from the General Fund fund balance to reimburse the Street, Bridge, and Sidewalk Millage Fund for the design and public engagement costs of the Northside STEAM Safe Routes Sidewalk Gap Project. 

 

On October 2, 2017, City Council approved Resolution #R-17-377 in support of the application for Safe Routes to School funding.  On February 20, 2018, City Council approved Resolution No. 1 (#R-18-055) to direct the City Administrator to prepare plans and specifications for the project. On December 3, 2018, City council voted to postpone the vote of Resolution #2 for the project due to concerns regarding the impacts of the project on vegetation.  Staff considered these concerns and made significant design changes to the project and Resolution #2 (R-18-501) was ultimately approved on January 7, 2019.  This action was followed by the approval of Resolution #3 (R-19-186), which established a Public Hearing date for the project.  Finally, on May 20, 2019 Resolution # 4, which was to confirm the special assessment roll was defeated and the project was terminated.  Total costs for the design and public engagements efforts for this work total $160,771.00.

 

Budget/Fiscal Impact:  The project was anticipated to have costs paid by federal-aid and a local share paid by the Street, Bridge, and Sidewalk Millage; therefore, the project was established in the Street, Bridge, Sidewalk Millage fund, which fronted the design and public engagement costs of the project.  Per Chapter 12, Sections 1:274-5 of the City code, the costs for the addition of new sidewalk where none currently exists is born by the parcels that benefit from the improvements.  Because the project did not move forward the costs are required to be re-paid to the Street, Bridge, and Sidewalk Millage Fund

Whereas, On May 20, 2019, the Street, Bridge, and Sidewalk Millage project, Northside STEAM Safe Routes to School (STRS) Sidewalk Gap, was effectively terminated by the defeat of Resolution #4;

 

Whereas, Defeated Resolution #4 would have allocated special assessments costs to reimburse the Street, Bridge, and Sidewalk Millage for the new sidewalk installation design, public engagement, and construction; 

 

Whereas, As required by Chapter 12, Sections 1:274-5 of the City code, the costs for the addition of new sidewalk where none currently exists is born by the parcels that benefit from the improvements; and

 

Whereas, The Northside STEAM Safe Routes to School (STRS) Sidewalk Gap project incurred $161,771.00 of design and public engagement costs;

 

RESOLVED, That $160,771.00 be appropriated from the General Fund fund balance to be transferred to the existing Northside STEAM Safe Routes Sidewalk Gap project; thereby, increasing the project revenue and expenditure budgets, for the purposes of refunding the Street, Bridge, and Sidewalk millage for the design and public engagement for said project; and

 

RESOLVED, That Council authorize the City Administrator to take necessary administrative actions to implement this resolution.
