Resolution to Approve Fees for Medical Marijuana Facilities/Adult Use Marijuana Establishment Permits
Memorandum
City Council passed ordinance amendments on October 7, 2019, that added adult use marijuana establishments to the permit requirements for medical marijuana facilities in Chapter 96 of the Ann Arbor City Code. Attached for your consideration and approval is a resolution establishing new fees for the single City permit that will authorize the operation of a medical marijuana facility, an adult use marijuana establishment, or both at a single location in the City of Ann Arbor provided the required state license(s) has/have been issued under the Medical Marihuana Facilities Licensing Act (MMFLA) and the Michigan Regulation and Taxation of Marihuana Act (MRTMA).
The City Administrator is recommending that the maximum allowable fee of $5000 per application, under the MMFLA and the MRTMA, be approved.

Whereas, Chapter 96 of the Ann Arbor City Code was adopted in 2017 to allow for the issuance of permits and to regulate the operation of medical marijuana facilities within the City;
Whereas, On October 7, 2019, City Council passed an ordinance amendment to Chapter 96 to allow for the issuance of permits and to regulate the operation of adult use marijuana establishments within the City;
Whereas, Chapter 96 authorizes Council to set a non-refundable application fee; and
Whereas, State law allows for a maximum local fee of $5000.00 per application under the MMFLA and the MRTMA;
RESOLVED, That the following fee schedule for the application and issuance of permits under Chapter 96 become effective according to the dates listed in the schedule and remain in effect until further action of City Council;
