Memorandum

Attached for your review and approval is Resolution No. 4 establishing the date for the Public Hearing on the ---------------- Dhu Varren Sidewalk Improvements Project;  Special Assessment District No. 53, File No. 19-0881.

 

An administrative hearing explaining the project to property owners was held in April 2018.  Included in the discussions were cost estimates, property assessments and the work schedule.  Resolution No. 1 was previously approved on July 2, 2018.  Resolution No. 2 establishing the estimated cost of the project, the estimated project revenue sources and directing the preparation of the special assessment roll was approved by Council on June 17, 2019.  Resolution No. 3 scheduled the Public Hearing for July 15, 2019.

 

A summary of the project costs is provided below:

Federal Surface Transportation Grant                     $ 578,420.80            

Street, Bridge, and Sidewalk Millage                     $ 195,033.43 

Special Assessment                                                          $   78,955.37

Total Estimated Project Cost                                             $ 852,409.60

 

Per City ordinance, it is recommended that property special assessments up to $1,200.00 be billed in one installment.  Property special assessments over $1,200 shall be divided into equal installments as indicated in Chapter 12, subsection 1:275(2).

Body

Whereas, City Council, after due and legal notice, has met for the purpose of reviewing the Special Assessment roll prepared for the purpose of assessing the private property’s share of the cost of the following described public improvement to be defrayed by Special Assessment: Construction of a new sidewalk system along the north and south side of Dhu Varren Road between Omlesaad Drive and the Nixon Farm developments, Dhu Varren Improvements Project - Resolution No. 4; Sidewalk Special Assessment District No. 53, File No. 19-0881;

 

Whereas, That the City Council determine the cost of said improvements, including all incidentals, to be $852,409.60, and that of said total cost, $78,955.37 be paid by special assessment upon the properties specially benefited;

 

Whereas, City Council has heard all persons interested in the necessity of the improvement or aggrieved by the attached Special Assessment Roll and has considered any and all objections thereto; and

 

Whereas, City Council is satisfied with said Special Assessment Rolls.

 

RESOLVED, That said Curb and Gutter & Sidewalk Special Assessment Roll as prepared by the Assessor (and attached hereto) is confirmed, and the sum of $78,955.37 shall be paid by special assessment upon the properties specially benefited within the City in accordance with this resolution;

 

RESOLVED, That such special assessments up to $1,200.00 shall be billed in one installment and special assessments over $1,200.00 shall be divided into equal installments as indicated in Chapter 12, subsection 1:275(2);

 

RESOLVED, The first installment shall be due on July 1, 2020, and the subsequent installments to be due on July 1st of each and every year thereafter until paid in full;

 

RESOLVED, That the deferred installments of said Special Assessment Roll bear interest at the rate of 3.598% per annum, commencing July 1, 2020; and

 

RESOLVED, That the City Clerk is hereby directed to endorse the date of confirmation upon the Special Assessment Roll in accordance with Chapter 13, Code Section 1:291.
