Resolution Authorizing Storm Sewer Improvement Charges for 2945 Devonshire ($3,728.09)

Memorandum

Your approval is requested to levy storm sewer improvement charges totaling $3,728.09 on the property known as 2945 Devonshire Rd. This parcel was annexed in 2017.

 

City of Ann Arbor Code section 1:279, Chapter 12, requires the property owner to pay the property’s share of the local public improvements through the City Improvement charge. The $3,728.09 Storm Sewer Improvement Charge is to be levied and then made payable in four annual installments and will accrue interest at 3.06468% per annum on the unpaid balance.

 

The storm sewer main was constructed by the city in 1958.

 

It is therefore recommended that Council levy this Improvement charge according to the terms described above.

Whereas, The City constructed a Storm Sewer Main in 1958 located in Devonshire Road, which is a part of the City’s Storm Sewer System;

 

Whereas, The property at 2945 Devonshire Road annexed into the City of Ann Arbor on July 26, 2017, as notified by the State of Michigan;

 

Whereas, Improvement charges for the storm sewer in Devonshire Road constructed in 1958 are due. Cost forwarded improvement charges are: $440.95/acre * 0.59 acres * CF 14.33 = $3,728.09 for 2945 Devonshire Road; and

 

Whereas, Pursuant to Section 1:279, Chapter 12, of the Code of the City of Ann Arbor, the fair share of the cost of said improvement is levied against certain properties and the fair share for this property has not been previously paid;

 

RESOLVED, That Council levy an improvement charge against the following property that  is specifically benefited by the above improvements:

RESOLVED, That the full improvement charge levied is $3,728.09;

 

RESOLVED, That this improvement charge be divided into four equal installments with

the first installment to be due on July 1, 2019, and the three subsequent installments to be due on July 1 of each and every year thereafter, with the deferred installments of the Improvement charge to bear interest at the rate of 3.06468% per annum on Storm sewer;

 

RESOLVED, That the Public Services Area be directed to send a copy of this resolution

by electronic mail or first class mail to the owners of the property and to promptly have this resolution recorded in the office of the Register of Deeds of Washtenaw County, Michigan; and

 

RESOLVED, That this levied Improvement charge is to be invoiced to the owner, Steve & Dawn DuBuc, of the property known as 2945 Devonshire Rd., City of Ann Arbor, Washtenaw County, Michigan 48104, and to be credited in the amount of $3,728.09 to Fund 0069-070-1000-0000-7151.
