Resolution to Approve Street Closings for the Ann Arbor Marathon Running Event - Sunday, March 24, 2019

Memorandum

Attached for your consideration is a resolution to approve the closing of certain streets for the Ann Arbor Marathon Running Event on Sunday, March 24, 2019 from 3:30 A.M. to 1:30 P.M.

 

The sponsor, CFC-Epic Races, LLC, is raising money through this event for the Ann Arbor Public Schools Education Foundation (AAPSEF). Additional recipients include Team Red White and Blue, Juvenile Diabetes Research Foundation, The Kite Network, Ronald McDonald House of Ann Arbor, and SafeHouse.

 

The sponsor requests approval from the State of Michigan Liquor Control Commission for temporary sales, service and consumption of alcoholic beverages in the defined areas pursuant to the M.L.C.C. regulations.

 

The University of Michigan expressed objections to the event and a beer company being one of the sponsors of this event.  Their concerns and staff’s responses are attached.  Meetings with City staff, University representatives, City Police and the applicant were recently held.  Earlier meetings included the State Street District and South University Association.  The current route and location of the beer tent are the result of these meetings. 

 

The race is scheduled to begin with one start at 6:00 A.M. and the other at 7:30 A.M. and end by 1:30 P.M. to help bring the race to an earlier end.  The only additional noise at 6:00 A.M. will be to start the race.  The sponsor has requested to close the following streets between 3:30 A.M. and 1:30 P.M. and the streets will be reopened as soon as safely possible after participants have cleared the areas (many of these streets will occupy one lane only):

                     East Davis from Main to Greene

                     South Division from Hoover to Hill

                     Observatory to Geddes

                     Geddes to Huron Parkway

                     Huron Parkway to Dixboro Road

                     Dixboro Road to Gallup Park

                     Fuller Road to Fuller Court

                     Huron Parkway from Fuller Road to Geddes

                     Fuller Court between Gallup Park and E. Medical Center Drive

                     Washington Heights between E. Medical Center Drive and Observatory

 

The Sponsor will inform neighborhood associations and send postcards to impacted residents no later than one week prior to the event.  The City’s website will also include information about street closures for this event. 

 

The sponsor has requested approval for amplified music from 9:00 A.M. to 1:30 P.M. at the exit from Gallup Park and in the vicinity of the finish line (S. Main Street between William and Liberty.  Additionally, there will be loud announcements between 7:00 A.M. and 7:45 A.M. at the start line on S. Main at Keech. The sponsor’s noise plan includes the use of a band at the finish and at the exit from Gallup Park.  Additional music will be played via iPod or MP3 at aid stations, with only one station in a residential area.  The sound will be within the guidelines of the noise ordinance.

 

The sponsor agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, to comply with all City regulations governing the use of the streets, and will reimburse the City for all event expenses.  Notification of the street closings will be provided through the City’s website, GovDelivery, postcards, and temporary lawn signs from the sponsor.

 

The event has been coordinated with all relevant City service areas for the purposes of traffic control and for the protection of the health and safety of the participants and the general public.

Whereas, The street closures will be signed, barricaded and properly supervised;

 

Whereas, The Sponsor agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, and to comply with all City regulations governing the use of the streets;

 

Whereas, The Sponsor will submit an application for approval from the State of Michigan Liquor Control Commission for temporary sales service and consumption of alcoholic beverages in the defined areas pursuant to the M.L.C.C. regulations;

 

Whereas, The Sponsor has agreed to pay the cost of City services associated with the staging of this event; and

 

Whereas, Notification of the street closings will be provided through the City’s website, GovDelivery and the sponsor’s communication plan;

 

RESOLVED, That a special liquor license for the event be approved, contingent upon approval from the Michigan Liquor Control Commission;

 

RESOLVED, That the Sponsor will pay the cost of City services associated with the staging of this event; and

 

RESOLVED, That City Council approve the closing of the following streets on Sunday, March 24, 2019 from 3:30 A.M. to 1:30 P.M. with streets to reopen as soon as safely possible after participants have cleared the areas:
