Resolution Requesting City Planning Commission and City Administrator to Evaluate Potential Amendments to the Zoning Ordinance Regarding Temporary Outdoor Sales in the C3 District
Body
Whereas, It has been determined by Planning and Development Services staff that the provision allowing certain temporary outdoor sales and the display of goods and services as a special exception use (C1 Local Business District, Section 5:10.15(2)(g) of the Zoning Ordinance), is not contained in Section 5:10.23 (C3 Fringe Commercial District); and
 
Whereas, It may be appropriate to include the provision found in Section 5:12.15(2)(g), which allows certain temporary outdoor sales and the display of goods and services as a special exception use, in the C3 zoning district;
 
RESOLVED, That City Council requests the City Planning Commission and City Administrator to evaluate options for amending the C3 zoning district to include certain temporary outdoor sales and the display of goods and services as a special exception use;
 
RESOLVED, That City Council requests that the Planning and Development Services Unit review all current temporary outdoor sales in the C3 zoning district, as well as all recurring annual temporary outdoor sales, and to contact such users and provide a reasonable time for such users to comply with the temporary outdoor sales requirements of the C3 zoning district; and
 
RESOLVED, That recommendations be provided to Council no later than July 20, 2009.
