Resolution Ratifying the Issuance of an Emergency Purchase Order to the Detroit Edison Company for the Installation of Underground Electric Service by the City Administrator and Authorizing the City Administrator to take all Necessary Actions for the Installation of this Service ($25,059.53)
Memorandum
The attached resolution ratifies and approves the emergency issuance of a purchase order to The Detroit Edison Company (DTE) for the installation of underground electric service to replace overhead electric lines and the associated power poles that are in conflict with the construction of the Courts/Police addition to City Hall.
DTE has two power poles located on the south side of Ann Street that must be relocated due to construction of the new Courts/Police addition. These poles must be relocated prior to May 18th when the crane being used to place steel arrives onsite. To accomplish this permanent removal of these two poles, an underground service must first be installed on the north side of Ann Street from mid-block west of 5th (across from the Hands On Museum) to mid-block east of 5th (across from the temporary access to City Hall).
The City had requested the pole relocations and corresponding re-design of the electric feed more then six months ago. The plans and cost proposal for the underground installation were finally received from DTE on May 4, 2009, but was too late to bring to City Council for approval at its May 4, 2009, meeting. Having to work around the poles has created a hardship for the contractor already from both a project time and cost perspective. The failure to have the poles removed prior to the crane being on site would nearly shut the project down, causing the need for the emergency purchase order. DTE requires payment before they will schedule the work.
The City Administrator has exercised his authority under Chapter 14, Section 1:317 for an emergency purchase order for this work and this memorandum reports the reasons. The City Attorney has reviewed and approved the emergency purchase order.

Whereas, The City of Ann Arbor is currently constructing the Courts/Police addition to the Ann Arbor City Hall;
Whereas, To maintain the construction schedule and avoid unnecessary delays and costs, the City finds it necessary to have The Detroit Edison Company install underground electric lines to replace the electrical feed of two electric poles that will be permanently removed on the south side of Ann Street adjacent to the Court/police addition construction site;
Whereas, It is necessary to contract with The Detroit Edison Company to complete this work based upon their proposal dated May 4, 2009;
Whereas, Sufficient funds are available within the existing Municipal Center project budget for the proposed expenditure; and
Whereas, The City Administrator has exercised his authority under Chapter 14, Section 1:317 for an emergency purchase order for this work and the City Attorney has reviewed and approved the emergency purchase order;
RESOLVED, That the purchase order to The Detroit Edison Company in the amount of $25,059.53 for the installation of underground electric service issued under the City Administrator's authority granted in Chapter 14, Section 1:317 of the Ann Arbor City Code be ratified and approved;
RESOLVED, That the City Administrator be authorized to execute all necessary documents for this work in connection with the construction of the Courts/Police addition to City Hall; and
RESOLVED, That the City Administrator be authorized to take necessary administrative action to implement this resolution.
