Memorandum
Attached for your consideration is a resolution that authorizes a one-year contract in the amount of $208,800.00 with Saladino Construction Co. for concrete repairs throughout the City.  The resolution also authorizes an option to extend the contract with Saladino Construction Co. for two additional one-year periods for a total of $626,400.00 with the same terms and conditions subject to the annual appropriation of funds in FY2010 and FY2011.  
 
The contract is a unit price contract for miscellaneous concrete work at various locations throughout the City.  There are 44 work items included in the contract.  The contract quantities are estimates based on the performance of similar City projects over the last three years.  The majority of the work is expected to be for corner ramp ADA compliance, curb and gutter damaged by snowplows, drive apron repairs at the public alleys and sidewalk repair at City owned Parks and other facilities.
 
Requests for bids were posted online and bids were received from four contractors. After evaluating the bids, Staff determined that the prices were competitive and recommends Saladino Construction Co. to be awarded the contract.  The bid tabulation is attached.  Funding for this work is budgeted in the Public Services Area, Field Operations Unit FY 2009 operations and maintenance budget.
 
Saladino Construction Co. received Human Rights approval on April 8, 2009, and pays their employees a "living wage".

Whereas, Sealed bids for Miscellaneous Concrete Repairs were received in November 2008, and Saladino Construction Co. was the lowest responsible bidder;
 
Whereas, The Public Services Area recommends approval of a one-year contract with Saladino Construction Co., with the option to extend the contract for two additional one-year periods under the same terms and conditions;
 
Whereas, Funds are available in the FY 2009 Public Services Area, Field Operations Unit operating budget for the scheduled concrete repairs throughout the City;
 
 
Whereas, It is anticipated that sufficient funds will be appropriated in the FY2010 and FY2011 Public Services Area, Field Operations Unit operating budget should the City elect to exercise its option and extend the term of the contract; and
 
Whereas, Saladino Construction Co. received Living Wage and Contract Compliance approval on April 8, 2009;
 
RESOLVED, That City Council approve a contract, per Bid No. ITB - 3978, with Saladino Construction Co., in the amount of $208,800.00 for one year with the option to extend the contract for two additional one-year periods for concrete repairs upon appropriation of the necessary funds in the FY2010 and FY2011 budgets for a total estimated amount for the three years of $626,400.00;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract and the extensions thereof after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution.
