Resolution to Approve Parkwood Street Vacation, Located Between Kingwood Street and Valley Drive (CPC Recommendation: Approval - 7 Yeas and 0 Nays)
Memorandum
Approval of this resolution will vacate the unconstructed portion of Parkwood Street, located within the City-owned Evergreen Park, as described in the attached resolution.  On February 19, 2009, the City Planning Commission recommended approval street vacation.  On April 6, 2009, Council approved a resolution of intent to vacate this alley.

Body
Whereas, The City of Ann Arbor Parks and Recreation Services, has requested vacation of the unconstructed portion of Parkwood Street;
 
Whereas, The Ann Arbor City Planning Commission, on February 19, 2009, reviewed said request;
 
Whereas, The Ann Arbor City Council, on April 6, 2009, approved a resolution of intent to vacate the unconstructed portion of Parkwood Street and hold a public hearing on the matter on May 18, 2009; and
 
Whereas, The Ann Arbor City Council held a public hearing on the matter on May 18, 2009;
 
RESOLVED, That City Council approve the Parkwood Street Vacation, Located Between Kingwood Street and Valley Drive;
 
RESOLVED, That except for certain easement rights that it reserves, below, the City hereby agrees to quit claim all rights it has in the portion of Parkwood Street as described above;
 
RESOLVED, That the City hereby reserves easement rights for public and private utilities in, on and over all of that portion of the vacated portion of Parkwood Street, including reserving the right to operate, repair, replace and maintain the public utilities located in the portion of Parkwood Street; and
 
RESOLVED, That a certified copy of this resolution be recorded with the Washtenaw County Register of Deeds as soon as practicable following approval of this resolution.
