Memorandum
There is a resolution before you to accept an easement for public road right-of-way from 201 DEPOT, LLC, a Michigan limited liability company, for the maintenance of public roads.
 
The easement is in standard form and conveyed without cost to the City.
 
Acceptance of the easement is recommended.

Whereas, 201 DEPOT, LLC, a Michigan limited liability company, is the owner in fee simple of property located in the City of Ann Arbor, Washtenaw County, Michigan as described in the Washtenaw County Records at Liber 4490, Pages 936 and 937, recorded July 8, 2005;
 
Whereas, A Resolution of the Managing Members of 201 DEPOT, LLC, a Michigan limited liability company, dated April 21, 2009, authorizes the delivery of a perpetual easement to the City for public road right-of-way along the north side of Depot Street; and
 
Whereas, 201 DEPOT, LLC, has delivered an easement to the City for public road right-of-way to run with the land and burden the respective property perpetually, being more particularly described as follows:
 
Located in the SE 1/4 of Section 20, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan
 
Commencing at the South 1/4 corner of Section 20, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan; thence N87°53'30"E 328.73 feet along the centerline of Felch Street as shown in Assessor's Plat No. 22 in the City of Ann Arbor and recorded in Liber 9 of Plats, page 6, Washtenaw County Records; thence N89°43'00"E 339.39 feet along the centerline of said Felch Street; thence N19°14'00"E 783.14 feet along the centerline of North Main Street; thence N13°05'30"E 205.76 feet along said centerline of North Main Street; thence N65°37'20"E 41.58 feet to the Southwest corner of Block XI of Ormsby and Page Addition to the City of Ann Arbor as recorded in Liber 19, page 191, Washtenaw County Records; thence S61°50'40"E 274.92 feet along the Northerly line of Depot Street (66 feet wide) for a PLACE OF BEGINNING; thence N27°54'20"E 0.43 feet; thence S63°06'04"E 300.57 feet; thence S61°48'08"E 44.43 feet; thence S61°48'08"E 140.44 feet; thence S51°31'53"E 11.81 feet; thence S63°31'52"E 32.73 feet; thence S31°19'10"W 6.82 feet; thence along the Northerly Right-of-Way line of Depot Street the following two courses: N61°40'55"W 344.79 feet and N61°48'54"W 184.53 feet to the Place of Beginning, being a part of Blocks XI & XII Ormsby and Page Addition to the City of Ann Arbor as recorded in Liber 19, page 199 Washtenaw County Records.
 
RESOLVED, That the City hereby accept said grant of easement.
