Title
An Ordinance to Amend Section 1:17 of Chapter 1 (Adoption, Contents, and Interpretation) of Title I of the Code of the City of Ann Arbor for the Public Services Field Operations Solid Waste Unit (Ordinance No. ORD-09-15)
Memorandum
This ordinance amends Section 1:17 of Chapter 1 of the Code of the City of Ann Arbor.  These amendments are being recommended to allow greater enforcement capabilities within the Systems Planning Unit for Solid Waste issues under Chapter 26 (Solid Waste Management) and for Urban Forestry issues under Chapter 40 (Trees and Other Vegetation).
 
The changes in relation to Chapter 26 are being recommended to provide assistance with the rollout of the commercial Solid Waste franchise and the expansion of the commercial recycling program.  All commercial solid waste haulers in the city are required to be licensed as of April 15, 2009.  Part of the license requirements includes providing a customer list with contract expiration dates.  These locations will be transitioned to the solid waste franchise over the next two years starting July 1, 2009.  By June 30, 2011, all locations (except for this with national accounts) will be transitioned to the solid waste franchise, even if the contract has not expired.  It is not expected that extensive enforcement action will be needed with this program, but it would be helpful to have this tool available to Systems Planning staff if needed since staff will be in the field on an ongoing basis.  
 
With regards to the expanded commercial recycling program, there will be a two year roll-out of that program.  Effective July 1, 2011, businesses will be required to either participate in the City's recycling program or provide reporting on their own recycling programs.  It will be helpful to have enforcement capabilities available to Systems Planning staff if such steps are needed.   
 
There have also been some staffing changes within the Systems Planning Unit, and the ordinance is being revised to reflect these changes.  The Land Development Coordinator has been replaced with the Stormwater and Floodplain Programs Coordinator.  Also, the new position of Urban Forestry and Natural Resources Planning Coordinator has been added.  It is proposed that both of these positions be given enforcement capabilities with regards to Chapter 40.  Previously, the Land Development Coordinator had these capabilities.  
 
Finally, there have also been some staffing changes within the Field Operations Services Unit.  The positions of City Forester and Park Ranger have been eliminated.  The ordinance has been adjusted to reflect these changes.

AN ORDINANCE TO AMEND SECTION 1:17 OF CHAPTER 1 (ADOPTION, CONTENTS AND INTERPRETATION) OF TITLE I OF THE CODE OF THE CITY OF ANN ARBOR.
 
 
The City of Ann Arbor Ordains:
 
Section 1.      That Section 1:17 of Chapter 1 of Title I of the Code of the City of Ann Arbor be amended to read as follows:
 
1:17.  Code violation citations.
The administrators of the following services areas and the persons holding the positions or performing the functions listed within each services area are authorized to issue citations for violations of the indicated chapters of this Code. This designation of authority is in addition to that otherwise provided by law.
