Resolution to Quitclaim a Reversionary Right to the University of Michigan at the Dental School (8 Votes Required)

Memorandum

In 1899, the City deeded certain land to the University of Michigan, part of which was used to construct the Dental School. The City reserved an interest which provides that the property will revert to the City if certain conditions of the deed are not met, including that the University construct and maintain a hospital. The deed also provided that the University would maintain two hospital beds with free medical care.

 

The University contacted City staff seeking the City's release of a reversionary right that covers a portion of the University of Michigan School of Dentistry building. The University stated that this was necessary to secure funding through the State Building Authority for the renovation of the building.

 

This resolution authorizes a quitclaim deed to the University of Michigan releasing the City’s reversionary right in the portion of the property underneath the Dental School. The right remains in the other portion of the property.

Whereas, The University of Michigan has requested the City release its reversionary right in a portion of land underneath the University’s School of Dentistry building, which right is recorded in a deed at Liber 142, Page 113, Washtenaw County Records;

 

Whereas, the University through multiple outlets, including Michigan Medicine and the School of Dentistry, continues to provide health care at a reduced rate or at no cost to certain Ann Arbor residents in keeping with the spirit of the provision in the deed which states that “…there should at all times be reserved and maintained within the said Hospital two beds devoted to free use of the sick and injured among the inhabitants of the City of Ann Arbor….”

 

Whereas, The University of Michigan provided medical and dental care of $7,100,000 in reduced fees, or at no charge, to Ann Arbor residents in the year ended June 30, 2017, including $1,293,000 of discounted dental care and $16,500 of free dental care;

 

RESOLVED, That the City Council authorizes and directs the Mayor and City Clerk to execute a quitclaim deed, after approval as to form by the City Attorney, to the Regents of the University of Michigan to release the City’s reversionary right in the following property:

 

Part of the Homestead Lot of R.S. Smith’s Third Addition to the City of Ann Arbor according to the plat thereof recorded in Liber 1 of Plats, page 5, Washtenaw County Records, described as follows:

Commencing at an iron pipe found in a monument box at the centerline intersection of Fletcher Street to the north and North University Avenue per the plat of "Eastern Addition to the Village (now City) of Ann Arbor" as recorded in Liber P, page 4 and 5, Washtenaw County Records, Washtenaw County Michigan; thence N88°25'33"E 348.19 feet along the centerline of said North University Avenue; thence N43°51'00"W 7.60 feet; thence N01°11'00"W 24.66 feet for a Place of Beginning; thence continuing N01°11'00"W 198.42 feet; thence S88°49'00"W 19.80 feet; thence N01°11'00"W 55.44 feet; thence N87°03'03"E 67.19 feet; thence S01°16'53"E 84.00 feet; thence S88°42'26"W 5.23 feet; thence S01°20'17"E 32. 71 feet; thence S88°32'18"W 10. 76 feet; thence S01°22'54"E 24.88 feet; thence N88°57'08"E 5.00 feet; thence S01°21'48"E 83.11 feet; thence N88°41'45"E 14.89 feet; thence S01°24'27"E 20.08 feet; thence S88°45'02"W 15.09 feet; thence S01°21'02"E 15.10 feet; thence S88°43'36"W 16.97 feet; thence the following two (2) courses along the northeasterly and north right of way line of said North University Avenue right-of-way line, N43°47'15"W 4.53 feet, and N88°46' 47"W 16. 76 feet to the Place of Beginning.
