Memorandum
This is to recommend approval of the attached resolution authorizing an amendment to the Professional Services Agreement with Hubbell Roth & Clark, Inc (HRC) for construction engineering services for the West Stadium Blvd. at Pauline Blvd. Improvements Project.
 
In December 2007, the City entered into an agreement with HRC for design engineering services for the West Stadium Improvements Project (Pauline to Seventh).  This project is a continuation of the West Stadium Blvd reconstruction that was completed north of Pauline Blvd in 2006.  The first phase of the project will reconstruct West Stadium Blvd at Pauline Blvd to approximately Suffolk Avenue.  This construction is expected April to August 2009.  Bids for the construction of the 2009 phase were opened by MDOT on December 5, 2008 and Council approved the City-State agreement on January 5, 2009 (08-1059).
 
Because HRC prepared the design and is most familiar with the project, they are best suited to provide the construction engineering services.  
 
Below is the breakdown of the scope of services included in the proposed amendment.
 
Construction Engineering ($31,795.00).  HRC will provide construction engineering assistance on an as-needed basis, including preparing field design changes, reviewing construction claims and contractor submittals, meeting with the neighbors, weekly meetings with the contractor, and review of survey cut sheets.
 
Construction Staking and Surveying ($61,521.00).  HRC will provide all the necessary construction staking and layout throughout the job.  
 
The attached resolution authorizes an Amendment to the Professional Services Agreement for $93,316.00.   HRC's existing Professional Services Agreement for this project is $467,601.00.
 
HRC received Human Resources Department approval on January 8, 2009.  Employees working on this project will be paid living wages per the contract.
 
The amendment will be funded from the previously approved project budget in which sufficient funds exist.

Whereas, Construction engineering and construction staking services are required for the West Stadium at Pauline Improvements Project;
 
Whereas, Hubbell Roth & Clark, Inc. has demonstrated the required experience, personnel, and competitive fees to provide construction engineering services for the West Stadium Blvd. at Pauline Blvd. Improvements Project;
 
Whereas, Hubbell Roth & Clark, Inc. designed the project for the City;
 
Whereas, Hubbell Roth & Clark, Inc. received Human Rights approval on January 8, 2009 and complies with the living wage ordinance; and
 
Whereas, Funding for this amendment is available in the previously established project budget;
 
RESOLVED, That the City Council authorizes an amendment to the professional services agreement with Hubbell Roth & Clark, Inc. in the amount of $93,316.00 for construction engineering services for the West Stadium Blvd. at Pauline Blvd. Improvements Project;
 
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute said amendment after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and
 
RESOLVED, That a contingency amount of $10,000.00 be established within the project budget and the City Administrator be authorized to approve amendment to the Professional Services Agreement with Hubbell Roth & Clark, Inc. not to exceed $10,000.00 in order to satisfactorily complete the project; and
 
RESOLVED, That Council authorizes the City Administrator to take necessary administrative actions to implement this resolution.
