Resolution to Approve a Professional Services Agreement with GEI Consultants of Michigan, P.C. for the Hydroelectric Dams FERC Part 12 Inspection and Report - RFP #17-31 ($118,500.00)

Memorandum

This memorandum and resolution requests approval of a professional services agreement for professional engineering services with GEI Consultants of Michigan, P.C. for a total of $118,500.00.

 

The Barton and Superior Dams are the two hydroelectric generating dams operated by the City and regulated by the Federal Energy Regulatory Commission (FERC).  FERC requires the City to utilize a FERC-approved Independent Dam Consultant to complete a Part 12 inspection and report every five years in accordance with FERC (18 CFR Part 12, Subpart D) requirements.  The last Part 12 Inspection and Safety Report was completed in 2013. 

 

In September 2017, the City of Ann Arbor (City) issued a request for proposals for professional engineering services for the Barton and Superior Hydroelectric Dams FERC Part 12 Inspection and Report.  The scope of this project includes two parts.  Part 1 includes the FERC Part 12 inspection and report to fulfill FERC Part 12 requirements.  Part 2 of the scope includes developing cost estimates for several dam removal and hydroelectric generator decommissioning scenarios.  The costs estimates included in Part 2 will aid the City in evaluating the financial viability of continuing to operate the hydroelectric generating components at both Superior and Barton Dams. 

 

The City received four (4) proposals for this work from the following firms: GEI Consultants of Michigan, P.C. (GEI), Bergmann P.C., Ayres Associates, and Stantec Consulting Michigan, Inc.   After initial evaluation using the scoring system outlined in the Request for Proposal (RFP), the City determined that GEI was the most qualified firm to provide these services.  It is therefore recommended that City Council approve the professional services agreement with GEI to perform the professional engineering services for the Hydroelectric Dams FERC Part 12 Inspection and Report.

 

GEI Consultants of Michigan, P.C. complies with the City’s Living Wage and Non-discrimination ordinances.

 

The project is to be funded from the FY18 General Fund Operating and Maintenance Budget and the FY19 General Fund Operating and Maintenance Budget, if so approved by Council.

Whereas, The City issued a Request for Proposal for professional engineering services for the Water Treatment Services Unit for the Hydroelectric Dams FERC Part 12 Inspection and Report, RFP #17-31;

 

Whereas, Professional engineering services are required to fulfill Federal Energy Regulatory Commission (FERC) Part 12 inspection and reporting requirements;

 

Whereas, The City also requested engineering and cost estimating services to evaluate the long term viability of continuing to operate the hydroelectric generating components at both Superior and Barton Dams;

 

Whereas, Of the four (4) proposals received, GEI Consultants of Michigan, P.C. was selected as the most qualified firm to provide the required engineering services;

 

Whereas, The funds are available in the approved FY18 General Fund Operating and Maintenance Budget;

 

Whereas, Professional engineering services for FY19 will be funded from the FY19 General Fund Operating and Maintenance Budget, if so approved by Council; and

 

Whereas, GEI Consultants of Michigan, P.C. complies with the City’s Living Wage and Non-discrimination Ordinances;

 

RESOLVED, That Council accepts the proposal and awards a Professional Services Agreement to GEI Consultants of Michigan, P.C. in the amount not to exceed $118,500.00;

 

RESOLVED, That a contingency in the amount of $12,000.00 be approved to finance change orders to the professional services agreement with GEI Consultants of Michigan, P.C. to be approved by the City Administrator;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract for services after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution;

 

RESOLVED, That the professional engineering services be to be funded from the approved FY18 General Fund Operating and Maintenance Budget;

 

RESOLVED, That the professional engineering services be to be funded from the FY19 General Fund Operating and Maintenance Budget if so approved by Council; and

 

RESOLVED, That the funds be available for the life of the project without regard to fiscal year until the services under the Professional Service Agreement are completed.
