Memorandum

Attached for your review and approval is a resolution to authorize Amendment No. 3 to the Professional Services Agreement with Environmental Consulting and Technology, Inc. (ECT) for the Sister Lakes Stormwater Retrofit Project. 

 

Budget/Fiscal Impact

This project is included in the City’s Capital Improvement Plan (CIP) as project UT-ST-16-11, and is budgeted in the approved Stormwater Capital budget. Any long term maintenance associated with the proposed work would be budgeted from Stormwater Operations and Maintenance funds.

 

Background

Through a Request for Proposal (RFP #976) the City selected ECT to provide design services for a project to provide water-quality improvements, conveyance modifications, and ecological habitat improvements that will protect and enhance First Sister Lake. Based on input received at several neighborhood meetings, the design scope of work was expanded and authorized through two amendments to the professional services agreement. Amendment No. 2, which brought the contract above the $25K threshold, was approved by Council on July 17, 2017.

 

The resulting final design is a bio-filtration garden that removes the pollutants from the first flush of stormwater runoff from the adjacent neighborhood before releasing the water into First Sister Lake. There is a companion resolution before Council to authorize a contract for construction of the project in accordance with this design.

 

Based on its extensive background and experience with similar projects, staff requested that ECT provide a scope and budget for professional services through the bidding and construction phases, including submittal reviews, inspection, field change evaluation, and other services that may be required through completion of the project.

 

ECT’s fee for these services is the cost of time and materials consistent with the provisions of its existing contract, up to a not-to-exceed amount of $24,000.00.  ECT and the City are also asking for a $6,000.00 contingency to cover additional services.  The combined $30,000.00 would bring the total authorized amount on this contract to $61,897.00.

 

ECT is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances.

Whereas, Environmental Consulting and Technology, Inc. (ECT) is under contract to provide professional design services for the Sister Lakes Stormwater Retrofit Project, has completed the design plans for the project, and has background and experience with construction-phase services for other, similar projects;

 

Whereas, ECT has provided a scope and budget to the City to provide professional services through the construction phase of the project;

 

Whereas, ECT is in compliance with the requirements of the City’s Non-Discrimination and Living Wage ordinances; and

 

Whereas, The funds for this Amendment to the Professional Services Agreement are available within the approved Stormwater Fund Capital Budget;

 

RESOLVED, That Amendment No. 3 to the Professional Services Agreement with ECT in the amount of $24,000.00, plus a contingency of $6,000.00 for additional services, for a combined amount of $30,000.00, be approved for the Sister Lakes Stormwater Retrofit Project, for a total authorized amount of $61,897.00 on ECT’s contract;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment after approval as to form by the City Attorney and approval as to substance by the City Administrator; and,

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
