Memorandum
Attached for your review and action is a resolution to approve a contract with D & J Lawn and Snow, Inc. for $31,823.00 to replace park sidewalks per Bid #3993, and to establish a total construction project budget of $35,005.
 
The 2006-2011 Park and Recreation Open Space Plan identified infrastructure improvements, including repair of walks and trails, as a high priority.  The condition of walks in a number of the parks are deteriorated and in need of renovation.  Parks that will be included in the walk replacement project include Leslie Park at Pontiac Trail, Sugarbush Park, South Maple Park, and Huron Highlands Park.  Funding for the walk replacement project is included in the approved FY 09 Park Rehabilitation and Development Millage budget.
 
Bid documents were advertised on MITN.  Thirteen companies submitted bids for the project as follows:

The resolution includes a recommended construction contingency of $3,182.00 (10%) to cover potential contract change orders to be approved by the City Administrator.  It is requested that a $35,005 total construction project budget be established for the life of the project without regard to fiscal year.
 
D & J Lawn and Snow, Incorporated meets the living wage and prevailing wage requirements and received Human Rights approval on February 4, 2009.

Body

Whereas, Funds for the project are included in the approved FY 09 Parks Rehabilitation and Development Millage budget;
 
Whereas, The areas identified for funding in FY 09 include Leslie Park at Pontiac Trail, Sugarbush Park, South Maple Park, and Huron Highlands Park; and
 
Whereas, D & J Lawn and Snow, Inc. received Human Rights approval on February 4, 2009 and complies with the living wage and prevailing wage requirements;
 
RESOLVED, That City Council approve a construction contract, per Bid #3993, with D & J Lawn and Snow, Inc. for $31,8230.00 and approve a construction contingency of $3,182.00 (10%) to cover potential contract change orders for a total project budget of $35,005.00 to replace park sidewalks at Leslie Park, Sugarbush Park, South Maple Park and Huron Highlands Park for the life of the project without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
