Title

An Ordinance to Amend Chapter 55 (Zoning) related to Medical Marijuana Facilities (Ordinance No. ORD-17-21) (CPC Recommendation: Approval - 7 Yeas and 0 Nays)

Memorandum

Approval of this ordinance will bring zoning for medical marijuana facilities into alignment with State of Michigan legislation on medical marijuana passed in 2016. Amended sections include §5:10.14 (RE research district), §5:10.14A (ORL office/research/limited industrial district) §5:10.15 (C1 local business district), §5:10.16 (C1A campus business district), §5:10.17 (C1B community convenience center), §5:10.18 (C1A/R local business district), §5:10.19 (D1 and D2 downtown districts), §5:10.21 (C2B business service district), §5:10.23 (C3 fringe commercial district), §5:10.24 through 26 (M industrial districts), §5:10.27 (PUD planned unit development district), and §5:50.1 Regulations Concerning Medical Use of Marijuana.

 

The City Planning Commission made the following modifications to the draft ordinance at their October 17, 2017 meeting:

                     Grower and Processor were added as special exception uses in the ORL (Office/Research/Limited Industrial) district.

                     Facilities allowed in M districts were changed from special exception uses to permitted uses.

                     The 1000 foot spacing requirement was removed for all medical marijuana facility types except provisioning centers.

                     In the RE and ORL district, a maximum of two allowed facility types may co-locate on one parcel. In the M district, up to five facility types may co-locate on one parcel.

 

The City Planning Commission, at its meeting of October 17, 2017, recommended approval of this request.
