Resolution to Approve a Professional Services Agreement with Brush Design, LLC for “Leaven” Public Art for the Stadium Boulevard Reconstruction Project - S. Main Street to Kipke Drive ($100,000.00)

Memorandum

On April 29, 2016 Council passed Resolution R-16-152 (copy attached) that approved the Professional Services Agreement with the Ann Arbor Art Center to supervise an artist selection process. This resolution detailed the process to be used to select the artist and the timeline to be followed during the selection process. Since that time, staff has worked with the Art Center personnel with regard to the selection process and to negotiate the final scope and overall concept of the proposed public art project. 

 

On February 17, 2017 the Ann Arbor Public Art Commission accepted the recommendation of the Ann Arbor Art Center and Public Services Area Staff to approve the artist Brian Brush and his proposed project “Leaven” for the Stadium Boulevard Reconstruction Project. Attached, please find a copy of the memorandum that was prepared for the Public Art Commission and the final project report prepared by the Ann Arbor Art Center that details the selection process followed, provides information about the artist and the selected project, the Advisory Committee formed to help guide the selection process, and “Lessons Learned” during the selection process.

 

The attached Resolution is to request approval of the Professional Services Agreement with Brush Design, LLC to fabricate and construct the artwork. The agreement details the work to be performed, the project schedule, and the terms of payment to the artist for the work. The amount of the agreement is $100,000.00.

 

Budget/Fiscal Impact

Funds for public art associated with the Stadium Boulevard Reconstruction Project of $135,000.00 (which includes $35,000.00 in already expended costs associated with the selection process) has been included and is available in the existing Stadium Boulevard Reconstruction project budget. There are no anticipated operational impacts with the approval of this resolution.

Body

Whereas, The artist to design and install the public art associated with the Stadium Boulevard Reconstruction Project - S. Main Street to Kipke Drive has been recommended through a robust selection process;

 

Whereas, The Ann Arbor Public Art Commission has approved the recommendation of the Ann Arbor Art Center that was chosen to select the artist;

 

Whereas, Public Services Area Staff concurs with the recommendation of the Ann Arbor Art Center;

 

Whereas, Sufficient funds are available in the existing Stadium Boulevard Reconstruction project budget to cover the cost of the fabrication and installation of the artwork by Brush Design, LLC; and

 

Whereas, It is now necessary for Council to approve the professional services agreement with Brush Design, LLC for the needed work to fabricate and install the selected artwork;

 

RESOLVED, That City Council approve a professional services agreement in the amount of $100,000.00 for the fabrication and installation of the “Leaven” artwork by Brian Brush of Brush Design, LLC;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement, after approval as to form by the City Attorney and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution.
