Memorandum

This memorandum and resolution requests approval of a professional services agreement for professional engineering services with NTH Consultants, Ltd. for a total of $189,400.00.

 

In November 2016, the City issued a request for proposals for geotechnical engineering services for the Barton Dam Piezometer Installation and Slope Stability Analysis Project. Barton Dam is comprised of a powerhouse, spillway section and earthen embankments and is owned, operated and maintained by the City.  As part of the last safety inspection, the Federal Energy Regulatory Commission (FERC) identified areas along the earthen embankment where there was a possibility that the integrity of the embankment was compromised. Between December 2014 and November 2015, a geotechnical firm hired by the City installed piezometers, to measure the water surface elevation through the earthen embankment.  Review of twelve months of data has been inconclusive, and the City’s geotechnical consultant has recommended the installation of additional monitoring locations and data collection to ensure a thorough understanding prior to recommending remedial measures.

 

The scope of this project is to install additional piezometers, collect piezometer data, perform a stability analysis of the embankment, develop recommendations for remediation (if necessary), and to coordinate and respond to the Federal Energy Regulatory Commission. This project will more accurately define the groundwater regime present along the embankment and provide the analysis and recommendations necessary for future design of remedial measures. This project is included in the Council-approved Capital Improvement Plan.

 

The City received seven (7) proposals for this work from the following firms: NTH Consultants, Ltd., CTI and Associates, Inc., FK Engineering Associates, GEI Consultants of Michigan, PC, AECOM, DLZ Michigan, Inc., and Geocomp.  After initial evaluation using the scoring system outlined in the Request for Proposal (RFP), the City created a shortlist of the top four (4) firms, to which the fee proposals were requested.  After evaluation of the top proposals, along with their fees, it was decided that NTH Consultants, Ltd. was the most qualified firm to provide these services.  It is therefore recommended that City Council approve the professional services agreement with NTH Consultants, Ltd. to perform the geotechnical engineering services for the Barton Dam Piezometer Installation and Slope Stability Analysis Project.

 

NTH Consultants, Ltd. complies with the City’s Living Wage and Non-discrimination ordinances.

 

The Barton Dam Embankment Project is included in the FY17-FY23 CIP and proposed Capital Budgets of the Water Supply System and General Fund for $2,030,000.00.  The Barton Dam embankment functions to benefit both the hydroelectric production and the water supply system.  NTH Consultants Ltd was the most qualified firm and an additional $20,000 is required to be appropriated from general fund balance to issue this contract.

Whereas, Of the seven (7) proposals received, NTH Consultants, Ltd. was selected as the most qualified firm to provide the required engineering services;

 

Whereas, These services are required to install piezometers, collect piezometer data, perform stability analysis of the embankment, develop recommendations for remediation, coordinate and respond to the Federal Energy Regulatory Commission (FERC), and other related work, to more accurately define the groundwater regime and provide the background information, analysis and recommendations necessary for future design of remedial measures; and

 

Whereas, NTH Consultants, Ltd. complies with the City’s Living Wage and Non-discrimination ordinances,

 

RESOLVED, That Council accepts the proposal and awards a Professional Services Agreement to NTH Consultants, Ltd. in the amount not to exceed $189,400.00;

 

RESOLVED, That a contingency in the amount of $19,000.00 is approved to finance change orders to the professional services agreement with NTH Consultants, Ltd. to be approved by the City Administrator;

 

RESOLVED, That $20,000.00 be appropriated from general fund balance to increase the expenditure and revenue of the existing Barton Dam Embankment capital project budget,

 

RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the contract for services after approval as to substance by the City Administrator and approval as to form by the City Attorney;

 

RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
