The attached resolution requests withdrawal of the City’s objection to renewal of the Class C liquor license and permits currently held by A2MI Old Carolina Barbeque Company, LLC (d/b/a Old Carolina Barbeque Company)(Business ID. No. 235153)(Liquor License No. 234843-2016), SAE Young Corporation (d/b/a Nagomi Sushi and Noodles)(Business ID No.235045) (Liquor License No. 235762-2016) and 5Z Restaurants Ann Arbor, LLC (d/b/a BurgerFi)(Business ID No. 232181)(Liquor License No. 23085-2016)
Liquor licenses issued by the State of Michigan expire April 30th each year as establish by Michigan law (MCL 436.1501(2). On-premise liquor licenses require approval by the local legislative body before renewal of an existing license if an objection to renewal has been filed with the Michigan Liquor Control Commission by the local legislative body at least 30 days before April 30th of that year.
On February 6, 2017, City Council accepted the recommendation of the Council Liquor License Review Committee recommending Objection to Renewal of Old Carolina Barbeque Company’s, Nagomi Sushi and Noodles’s and BurgerFi’s liquor licenses and permits for failure to timely pay its 2015 personal property taxes. Council approved the matter for hearing on February 22, 2017.
On February 7, 2017, Old Carolina Barbeque presented the City Treasurer with payment of its outstanding personal property taxes. On February 8, 2017, Nagomi Sushi and Noodles’s presented the City Treasurer with payment of its outstanding personal property taxes. On February 21, 2017, BurgerFi presented the City Treasurer with payment of its outstanding personal property taxes.
There was no other basis for objection to renewal of Old Carolina Barbeque Company’s Nagomi Sush and Noodles’s and BurgerFi’s liquor licenses and permits for the 2017-2018 license year. Withdrawal of the Objection to renewal of the Class C liquor license and permits held by A2MI Old Carolina Barbeque Company, LLC (d/b/a Old Carolina Barbeque Company)(Business ID. No. 235153)(Liquor License No. 234843-2016) for the 2017-2018 license year is recommended. Withdrawal of the Objection to renewal of the Class C Resort liquor license and permits held by SAE Young Corporation (d/b/a Nagomi Sushi and Noodles)(Business ID No. 235045) (Liquor License No. 235762-2016) for the 2017-2018 license year is recommended. Withdrawal of the Objection to renewal of the Class C liquor license and permits held by 5Z Restaurants Ann Arbor, LLC (d/b/a BurgerFi)(Business ID No. 232181)(Liquor License No. 23085-2016) for the 2017-2018 license year is recommended.

Whereas, On February 7, 2017, Old Carolina Barbeque Company presented to the City Treasurer final payment of funds which now fully satisfies its outstanding amount of personal property taxes;
Whereas, On February 8, 2017, Nagomi Sushi and Noodles presented to the City Treasurer final payment of funds which now fully satisfies its outstanding amount of personal property taxes;
Whereas, On February 21, 2017, BurgerFi presented to the City Treasurer final payment of funds which now fully satisfies its outstanding amount of personal property taxes; and
Whereas, The Council Liquor License Review Committee’s recommendation for Objection to Renewal accepted by City Council included no other grounds for objection to renewal for these Licensees;
RESOLVED, That City Council, being fully advised in the matter, hereby withdraw all objections to renewal of the Class C Liquor License and Permits held by A2MI Old Carolina Barbeque Company, LLC (d/b/a Old Carolina Barbeque Company)(Business ID. No. 235153)(Liquor License No. 234843-2016) for the reason stated above and approve the application for renewal by Old Carolina Barbeque for the 2017-2018 License Year;
RESOLVED, That City Council, being fully advised in the matter, hereby withdraw all objections to renewal of the Class C Liquor License and Permits held by SAE Young Corporation (d/b/a Nagomi Sushi and Noodles)(Business ID No. 235045) (Liquor License No. 235762-2016) for the reason stated above and approve the application for renewal by Nagomi Sushi and Noodles for the 2017-2018 License Year;
RESOLVED, That City Council being fully advised in the matter, hereby withdraw all objections to renewal of the Class C Liquor License and Permits held by 5Z Restaurants Ann Arbor, LLC (d/b/a BurgerFi)(Business ID No. 232181)(Liquor License No. 23085-2016) for the reasons stated above and approve the application for renewal by BurgerFi for the 2017-2018 License Year; and
RESOLVED, That the City Clerk provide notice of the City Withdraw of its Objection to Renewal to the Licensees with a copy of this Resolution.
