Memorandum

This is to recommend approval of the attached resolution authorizing an Amendment Number 2 to the Professional Services Agreement with Orchard, Hiltz & McCliment, Inc. (OHM) for additional design engineering services for the Nixon/Green/Dhu Varren Intersection Improvement project.

 

On March 10, 2015, the City entered into an agreement with OHM for design engineering services for the Nixon/Green/Dhu Varren Intersection Improvement and the Nixon Road Corridor Traffic Study Project ($538,076.00 + $60,000.00 contingency). The Amendment # 1 for the $60,000.00 (contingency) was approved administratively on December 19, 2016. This Amendment # 2 would bring the total services amount with OHM to $693,726.00.

 

 

Design Engineering

 

A number of scope changes were made to the original contract at the request of staff.  Many of the changes required additional efforts by OHM and resulted in costs in excess of the contract amount. A summary of the additional work is as follows: 

 

1)                        Lighting Design along the Nixon Corridor from the Nixon/Green/Dhu Varren roundabout project limits south to Traver Blvd. Tasks included topography creation using record plans, lighting design, utility meetings, project meetings and management. A portion of this task ($24,350.00) was included in Amendment #1. The remaining amount of this task to be authorized under this amendment is $25,650.00.

 

2)                        Additional work to complete the MDEQ Joint Permit Application and plan preparation was required based on the request of the City to include the sidewalk along the frontage of the Toll Brothers property in the northwest and southwest quadrants of the Nixon/Dhu Varren intersection. It is beneficial to design this sidewalk work as part of the intersection project to assure continuity along the entire area, better coordinate with the design of the roundabout project and with the needs of other agencies (such as The Ride), and to minimize the impact on wetland areas.

 

This additional scope includes over 1,000 feet of extra sidewalk outside of the original footprint of the roundabout design. The total cost for the design and permitting work associated with this task is $70,000.00. Specifics of the work scope are outlined below:

 

a.    Additional sidewalk design plans were needed for the north and west legs of the intersection. Work to complete these plans included site visits, AutoCad design, cross section preparation, removal and construction plan sheets, detailed grading sheets, drainage design, soil erosion/sedimentation control sheets and cost estimate.

 

b.   Along with sidewalk design on the north leg, came the realignment of the north leg to minimize wetland impacts (keeping the sidewalk out of the wetlands to stay below 1/3 of an acre of impact). This realignment included additional utility impacts and utility coordination, design for the realignment, design for stormwater storage under this leg of the intersection, and multiple iterations of maintaining traffic plans based on the realignment and stormwater storage on this leg.

 

c.  MDEQ Joint Permit Application required revisions to include additional write-up, data, details/exhibits, more wetland mitigation design and investigations including survey.

 

Budget Impact

 

This amendment will be funded from the previously approved project budget in which sufficient funds exist. Toll Brothers has agreed to pay the extra cost ($70,000.00) for the additional sidewalk work.

Whereas, The City added additional services to the original contract scope with Orchard, Hiltz & McCliment, Inc. (OHM) as necessary to best address the project goals and therefore it is necessary to extend the contract with OHM to account for this expanded scope;

 

Whereas, OHM complies with the requirements of the City’s Non-Discrimination and Living Wage Ordinances;

 

Whereas, Toll Brothers has agreed to pay for a portion of the extra cost ($70,000.00) related to additional sidewalk work adjacent to their property; and

 

Whereas, Funding for this amendment is available in the previously established project budget;

 

RESOLVED, That the City Council authorizes Amendment Number 2 to the professional services agreement with Orchard, Hiltz & McCliment, Inc. in the amount of $95,650.00 for design engineering services for the Nixon/Green/Dhu Varren Intersection Improvement Project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and

 

RESOLVED, That Council authorize the City Administrator to take necessary administrative actions to implement this resolution.
