Memo
In early September, 2016, the Michigan Governor signed into law a series of legislative acts that create a path to state-issued licenses for medical marijuana businesses. These new state laws includes five (5) different types of license: provisioning centers, testing facilities, manufacturing facilities, growing facilities, and safe transport companies. The City's ordinances need to be amended. This resolution establishes a committee to review and recommend amendments to Title VII (businesses and trades), Chapter 95.

Whereas, The City of Ann Arbor voters passed a charter amendment in 2006 establishing legal protections for medical marijuana users; and

Whereas, The State of Michigan voters passed the Michigan Medical Marihuana Act in 2008 establishing legal protections for those who use and grow medical marijuana;

Whereas, The City of Ann Arbor approved ordinances in 2011 that identified locations and circumstances where medical marijuana could be grown and distributed to registered medical marijuana patients;

Whereas, The governor of Michigan signed into law further legislation in 2016 that clarify the circumstances and restrictions on growing and distributing medical marijuana to registered patients; and

Whereas, The new legislation establishing those circumstances and restrictions varies from Ann Arbor's current ordinances;

RESOLVED, That the City of Ann Arbor establishes a committee to make recommendations regarding which changes, if any, would be needed in order for our ordinances to comply with Michigan law;

RESOLVED, That this committee will consist of 5 members: 2 members of City Council and 3 residents of Ann Arbor with an interest in medical marijuana; and
