Resolution to Extend Toter Cart Purchases and Authorize Up to Five Additional Years (not-to-exceed $131,000.00 per year)

Memorandum

Attached for review and consideration is a resolution to extend the existing approval authorized by City Council Resolution Number R-12-546 for trash, recycling and compost cart purchases from Toter, Inc. through the end of FY20.  This previous purchase authorization was for one year, with City Administrator authorized to renew the purchase agreement for up to three additional fiscal years, ending in FY16. 

 

There remains a need to maintain a stock of carts for each solid waste program (refuse, recycling, and compost) as the existing carts are aging, and it is expected that there will be a large number of replacements needed as cart failures increase in the coming years. Also, with the anticipated new residential housing developments that will be coming online in the City within the next few years, the amount of carts needed will remain consistent.  Staff estimates that the following number of carts will be needed per year for the following four years:

 

                     Recycling Carts:                     1,500 carts

                     Compost Carts:                        400 carts

                     Refuse Carts:                          600 carts

 

The previously approved purchase agreement with Toter, Inc. is based on a long-term agreement between Toter, Inc. and the Metro Waste Authority of Des Moines, Iowa. The original Metro Waste Authority Agreement was competitively bid and the current pricing provided in the Metro Waste Authority agreement by an extension dated December 18, 2008, is competitive with Toter, Inc. carts that are provided by the National Intergovernmental Purchasing Alliance (IPA) agreement.  The Metro Waste Authority agreement is valid from October 1, 2010 through September 20, 2020. It allows the pricing from the agreement to be extended to other governmental entities.   

 

Ann Arbor currently uses Toter, Inc. carts for all of its solid waste curbcart needs (refuse, recycling, and compost).  Field crews have been satisfied with the durability of the Toter, Inc. carts and their ease of use. The Toter, Inc. carts are produced through a process called rotational molding and have a rough outside surface, which makes them easier to pick up with the automated arms on the City’s trucks. The rotational molding also produces a more flexible cart, which results in less cracking, particularly in cold weather.  Ann Arbor purchases its Toter, Inc. carts fully assembled, which reduces labor costs and lost parts. The recycling carts are purchased with full color instruction labels on the lids. 

 

Toter, Inc. complies with the City’s conflict of interest, non-discrimination and living wage ordinances.

 

 

 

Budget/Fiscal Impact

Funding for these services is available in the approved FY17 Solid Waste Operation and Maintenance Budget, and will be included in budget submittals for subsequent fiscal years.

Whereas, The City of Ann Arbor has realized benefits from the implementation of the cart program for its solid waste collection services, including recycling, refuse, and compost collection;

 

Whereas, The City of Ann Arbor currently uses Toter, Inc. carts for all of its solid waste curbcart uses;

 

Whereas, There is a need to maintain a stock of carts for replacing aging and damaged carts as well as for new customers;

 

Whereas, An agreement between the Metro Waste Authority of Des Moines, Iowa, and Toter, Inc., provides competitive pricing that other municipalities can use through September 20, 2020;

 

Whereas, On December 3, 2012 City Council approved Resolution R-12-546 authorizing the purchase of carts from Toter, Inc. with the City Administrator being authorized to renew the agreement for up to three additional fiscal years at an amount not-to-exceed $131,000.00 per year with the pricing based on the Metro Waste Authority Agreement Extension dated December 18, 2008 along with a supplemental options pricing list toe Ann Arbor dated October 19, 2011;

 

Whereas, Funding is available in the FY17 approved operation and maintenance budget of the Solid Waste Fund, and will be included in budget submittals for subsequent fiscal years; and

 

Whereas, Toter, Inc. complies with the City’s non-discrimination and living wage ordinances.

 

RESOLVED, That City Council authorize the City Administrator to extend the existing purchase agreement with Toter, Inc. for up to five additional fiscal years at an amount not-to-exceed $131,000.00 per year, subject to the annual appropriation of funds in those respective years;

 

RESOLVED, That pricing for the carts be based on the Metro Waste Authority Agreement Extension dated December 18, 2008 and effective extension October 1, 2010 through September 20, 2020, along with a supplemental options pricing list to Ann Arbor dated October 19, 2011;

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
