Resolution to Release a Water Main and Sanitary Sewer Easement at 2225 and 2245 S. State Street recorded at Liber 3918, Page 654 of Deeds, Washtenaw County Records; (8 Votes Required)
Memorandum
In 1999, City Council accepted a grant of easement from State Street Real Estate Company Limited Partnership for 40 foot wide water main and 30 foot wide sanitary sewer on the properties commonly known as 2225 and 2245 S. State Street. The properties are now owned by MEC Land, LLC and McKinley Executive Centre, LLC and are being developed as part of the State Street Village project. As part of the project, new sanitary sewer and water mains have been constructed and new easements for those utilities were placed before City Council for approval on October 6, 2016.
This easement is now superfluous, therefore release of the easement is recommended.

Whereas, In 1999, State Street Real Estate Company Limited Partnership granted to the City an easement for sanitary sewer and water main at 2225 and 2245 S. State Street, recorded at Liber 3918, Page 654 of Deeds, Washtenaw County Records;
Whereas, The current property owners, MEC Land, LLC and McKinley Executive Centre, LLC have signed new grants of easement for new sanitary sewer and water main; and
Whereas, The existing easement is no longer necessary;
RESOLVED, That the City of Ann Arbor hereby releases all rights pertaining to the sanitary sewer and water main easement recorded at Liber 3918, Page 654 of Deeds, Washtenaw County Records; and
RESOLVED, That an appropriate instrument, approved by the City Attorney, evidencing this release be recorded at the Washtenaw County Register of Deeds as soon as practicable following approval of this resolution.
