Resolution to Accept a Sanitary Sewer Easement at 2221 S. State Street from MEC Land, LLC (8 Votes Required)

Memorandum

Conveyance of this easement is part of the State Street Village development.

 

This easement is in standard form and is conveyed without cost to the City.

 

Acceptance of this easement is recommended.

Body

Whereas, MEC Land, LLC is the owner of property commonly known as 2223 S. State Street, Ann Arbor, Michigan 48104, described at Liber 4535, Page 41 and Liber 5067, page 474 of Deeds, Washtenaw County Records; and

 

Whereas, MEC Land, LLC has signed a grant of easement for sanitary sewers and appurtenances, described as:

 

Sanitary Sewer Easement Part 1:

 

A 52 foot wide sanitary sewer easement over part of Parcel #09-12-04-200-050, being land in the Northwest 1/4 of Section 4, T.3S., R.6E., Pittsfield Township, Washtenaw County, Michigan; said easement being more particularly described as: Commencing at the Northwest corner of said Section 4; thence along the West line of said Section 4, S00°37'30"E, 915.09 feet to the Northwest corner of said Parcel; thence along the North line of said Parcel N88°01'30"E, 274.05 feet to the East line of said Parcel; thence along said East line S01°58'30"E, 156.54 feet to the South line of said Parcel; thence along said South line 8.85 feet along the arc of a non-tangent curve to the left, having a radius of 230.00 feet, and a chord bearing N68°31'01"W, 8.85 feet to the POINT OF BEGINNING; thence along said easement the following five (5) courses:

 

1)                     continuing along the aforementioned South line 26.31 feet along the arc of a curve to the left, having a radius of 230.00 feet, and a chord bearing N72°53'46"W, 26.30 feet and;

2)                     continuing along said South line N76°10'23"W, 30.90 feet and;

3)                     N09°13'22"W, 24.48 feet and;

4)                     N80°46'38"E, 52.00 feet and;

5)                     S09°13'22"E, 48.24 feet to the aforementioned South line and the POINT OF BEGINNING; Containing ±1,861 square feet of land, more or less.

 

Sanitary Sewer Easement Part 2:

 

A variable width sanitary sewer easement over part of Parcel #09-12-04-200-050, being land in the Northwest 1/4 of Section 4, T.3S., R.6E., Pittsfield Township, Washtenaw County, Michigan; said easement being more particularly described as: Commencing at the Northwest corner of said Section 4; thence along the West line of said Section 4, L1) S00°37'30"E, 915.09 feet; thence L2) N88°01'30"E, 274.05 feet to the Northwest corner of said Parcel; thence along the West line of said Parcel L3) S01°58'30"E, 169.90 feet; thence continuing along said West line L4) S88°01'23"W, 3.09 feet the POINT OF BEGINNING; thence along said easement the following thirteen (13) courses:

 

L5)                     S24°10'49"E, 95.86 feet and;

L6)                     N89°59'29"E, 165.58 feet and;

L7)                     S34°15'16"E, 176.07 feet and;

L8)                     S89°09'00"E, 125.20 feet and;

L9)                     N80°25'22"E, 58.25 feet to the East line of said Parcel and;

L10)                     along said East line S23°28'00"E, 33.99 feet and;

L11)                     S80°25'22"W, 52.84 feet and;

L12)                     N89°09'00"W, 160.09 feet along the South line of said Parcel and the extension thereof and;

L13)                     N34°15'16"W, 175.78 feet and;

L14)                     S89°59'29"W, 193.24 feet and;

L15)                     N24°10'49"W, 123.07 feet to the aforementioned West line of said Parcel and;

L16)                     along said West line N00°25'00"W, 3.29 feet and;

L17)                     continuing along said West line N88°01'23"E, 54.73 feet to the POINT OF BEGINNING; Containing ±0.518 acres (±22,554 square feet) of land, more or less.

 

RESOLVED, That the City of Ann Arbor hereby accepts this grant of easement.
