Resolution to Approve a Michigan Department of Natural Resources Trust Fund (MNRTF) Grant Development Project Agreement for Gallup Park Universal Access Playground and Site Renovations and Accept and Appropriate Up to $300,000.00 in Funding (8 Votes Required)

Memorandum

Attached for your review and action is a resolution to approve a grant agreement from the Michigan Department of Natural Resources Trust Fund to construct a universal access playground and associated site improvements at Gallup Park, including a kayak pull out, an accessible fishing dock, landscaping, benches and picnic tables, and pathways. The Park Advisory Commission and Council approved submitting the grant application in 2015. $300,000.00 was applied for and the full amount was granted.

 

Funding for this project includes the $300,000.00 grant from the MNRTF, at least $350,000.00 from the Rotary Club of Ann Arbor, and $150,000.00 from previously approved Park Maintenance and Capital Improvements Millage funds. The project, a collaboration between the Rotary Club of Ann Arbor and the Parks & Recreation Services Unit, is identified in the Capital Improvements Plan. Design of the project is nearly complete, and construction is anticipated to start in spring, 2017. The approval of the Development Project Agreement will allow the project to move to the next stage of bidding and construction.

Whereas, The Michigan Department of Natural Resources approved a matching grant through the Michigan Department of Natural Resources Trust Fund (MNRTF) or (DEPARTMENT) for construction of Gallup Park Universal Access Playground and Site improvements,

 

Whereas, The Park Advisory Commission recommended approved the grant application on February 24, 2015, and City Council recommended approval of the grant application on March 16, 2015, and

 

Whereas, Local match funding for the project includes $350,000.000 from the Rotary Club of Ann Arbor and $150,000.00 from the Parks Maintenance and Capital Improvements Millage;

 

RESOLVED, That the City of Ann Arbor, Michigan, does hereby accept the terms of the Agreement as received from the Michigan Department of Natural Resources, and that the City of Ann Arbor does specifically agree, but not by way of limitation, as follows:

 

1.                     To appropriate all funds necessary to complete the project during the project period and to provide Five Hundred Thousand dollars to match the grant authorized by the DEPARTMENT.

2.                     To maintain satisfactory financial accounts, documents, and records to make them available to the DEPARTMENT for auditing at reasonable times.

3.                     To construct the project and provide such funds, services, and materials as may be necessary to satisfy the terms of said Agreement.

4.                     To regulate the use of the facility constructed and reserved under this Agreement to assure the use thereof by the public on equal and reasonable terms.

5.                     To comply with any and all terms of said Agreement including all terms not specifically set forth in the foregoing portions of this Resolution.

 

RESOLVED, That City Council accept and appropriate funding not to exceed $300,000.00 from the DEPARTMENT;

 

RESOLVED, That City Council approve the project agreement between the City and the Michigan Department of Natural Resources for the construction of the Gallup Park Universal Access Playground and Site Improvements;

 

RESOLVED, That Mayor and City Clerk be authorized and directed to execute the project agreement after approval as to substance by the City Administrator and to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
