Memorandum
City Council Resolution R-08-297 on July 7, 2008 recommended approval of the issuance of a Downtown Development District Liquor License to HBSP Holdings Corp d/b/a Salsarita's Fresh Cantina "above all others" to be specifically located at 401 E. Liberty, Suite #2, in Ann Arbor
 
In response to a request from the Michigan Liquor Control Commission, City Council further amended R-08-297 on August 7, 2008 (R-08-344), to add specific Class C license classification to its approval.
 
Recently, the City was advised that a new full-year Class C Quota License was available.   HBSP Holdings Corp. has petitioned to amend its application for a Development District license to an application for the full-year Class C Quota License.
 
The Council Liquor Committee having previously determined that HBSP Holdings Corp, as an existing restaurant business, has made a proven and measurable contribution to the community and that the designated premise, 401 E. Liberty Street, Suite #2, is an appropriate location for a liquor license under applicable planning and development plans of the City and being apprised that the application remains open, recommends approval of amendment of the application to a quota license request.

Whereas, City Council has previously approved and recommended HBSP Holdings Corp. d/b/a Salsarita's Fresh Cantina Application for a Class C Downtown Development District Liquor License (R-08-297 and R-08-344) under Public Act 501 of 2006, being MCL 436.1521a, "above all others" to be specifically located at 401 E. Liberty Street, Suite #2, Ann Arbor, Michigan  48104;
 
Whereas, At the time of City Council's approval of the Development District Liquor License no full-year Class C Quota license was available;
 
Whereas, One full-year Class C quota license is now available and HBSP Holdings Corp has petitioned to amend its pending application for a liquor license, to a full-year Class C Quota license; and
 
Whereas, The Council Liquor Committee having previously determined that HBSP Holdings Corp, as an existing restaurant business, has made a proven and measurable contribution to the community and that the designated premise, 401 E. Liberty Street, Suite #2, is an appropriate location for a liquor license under applicable planning and development plans of the City and being apprised that the application remains open, recommends approval of amendment of the application to a quota license request;
 
RESOLVED, That City Council acknowledges HBSP Holding Corp. d/b/a Salsarita's Fresh Cantina's request to amend its Application from a Class C Downtown Development License under MCL 436.1521a to a new full-year Class C Quota License and hereby amends and restates its approval of the amendment and recommends award of a new full-year Class C Quota License to HBSP Holding Corp. d/b/a Salsarita's Fresh Cantina "Above All Others" for its business at 401 E. Liberty Street, Suite #2, Ann Arbor, Michigan  48104; and
 
RESOLVED, That the City Clerk forward a copy of this resolution to HBSP Holding Corp. and the Michigan Liquor Control Commission.
