Memorandum
Attached is a resolution to approve the request from Habana, L.L.C. for a new Brew Pub Liquor License and a New Dance Permit to be held in conjunction within a 2008 Resort Class C Liquor Licensed Business, located at 205-207 E. Washington and 211 E. Washington - D/B/A Habana and Blue Tractor Cook Shop.  
 
The applicant is also requesting to transfer all interest in the 2008 Resort Class C Liquor License Business with an Entertainment Permit located at 211 E. Washington, by dropping John A. Carlson as a member through the transfer of 50% interest to new members, Chester F. Czaplicki, (12.5%), Frances S.L. Carlson (10%), Peter Schork (10%), Anthony Camilleri (5%), Sean McBride (5%), Todd Calloway (5%), and Barry J. Haven (2.5%); and drop Lobdell Dinning, L.L.C. as a member through the transfer of 50% interest to new members, Dan Glazer (30.01%) and Gregory M. Lobdell (19.99%).
 
The applicant is also requesting a new Outdoor Service (1 area) to be held in conjunction with the 2008 Resort Class C Liquor Licensed Business, with an  Entertainment Permit, to be located on a city sidewalk in front of 211 E. Washington St.
 
The applicant plans to conduct business under the name of Habana and the addition (205-207 E. Washington St.) will be operated as Blue Tractor Cook Shop.  Habana is a Cuban concept serving breakfast, lunch and dinner; and Blue Tractor Cook Shop is a barbeque style concept serving lunch and dinner.  The existing licensed first floor has seating for 100 patrons and encompasses 3,000 sq. ft.  The lower level has seating for 80 patrons and encompasses approximately 1,750 sq. ft.  The addition will be a first floor and basement addition and will have seating for approximately 141 patrons and will be approximately 6,700 sq. ft.  The hours of operation will be 7:00 am to 2:00 am seven days a week.  They currently employ 5 full and 40 part-time employees at the business and will add 2 full and 40 part-time employees.  Habana and Blue Tractor Cook Shop will serve multiple appetizers, sandwiches, salads and full course meals.
 
The Police, Planning and Development, Treasurer and Fire Services have approved the application, pending final inspections from the Fire and Planning and Development Services for the Blue Tractor Cook Shop, located at 205-207 E. Washington St.
 
There are no delinquent property taxes, all application fees are paid and there are no objections from City Staff.
 
The application was reviewed on Friday, October 17, 2008 by the Council Liquor License Review Committee. As part of the Committee's review due diligence, if continuation of an existing operation is contemplated as part of the license transfer, the Applicant is requested to present a plan to address any identified/existing problems created by the business and noted during the review process.  Habana, as an existing operation, was required to submit attached floor plans and management plans regarding liquor management staffing and safety in the back alley.  Approval was recommended pending the receipt of the attached plans.
