Memorandum
Attached for your review and action is a resolution to approve a construction contract with D & H Asphalt Co. in the amount of $49,955.50 to complete the pathway reconstruction as identified in Bid # 3970.  Funding for this project is included in the adopted FY 2007 Parks Rehabilitation and Development Millage - Fund 0018 budget.  Renovations and reconstruction of park bike path networks have been identified in the Parks and Recreation Open Space Plan, 2006 - 2011 and the City of Ann Arbor Non-Motorized Transportation Plan, 2007.  This portion of pathway in Mary Beth Doyle Park is in very poor condition and is the last remaining segment of bike path in this park that needs replacement.
 
As part of this construction contract, D & H Asphalt Co. will remove approximately 1,375 lineal feet of existing pathway materials, remove sub-base soils, and install an entirely new base limestone and bituminous asphalt pavement along with a maintenance entry gate.  This path section lies within the central portion of the park and continues easterly to the Verle Street entrance.
 
The project was advertised on MITN BidNet service and documents were available at the Procurement Office.  The proposal included an alternative price structure in an attempt to save on project costs, which we will accept in the award recommendation.  Six contractors submitted bids ranging from $49,955.50 to $93,685.50.  A bid tabulation of the base bids and alternative bids received is provided below:

The resolution includes a recommended construction contingency of $4,995.50 (10%) to cover potential contract change orders to be approved by the City Administrator and staff time of $1,248. It is requested that a total construction project budget be established of $56,199 for the life of the project without regard to fiscal year.
 
D & H Asphalt Co. will comply with the living wage and prevailing wage requirements and received Human Rights approval on September 8, 2008.

Whereas, Competitive bids were sought by the Procurement Office with bids received on September 4, 2008 and D & H Asphalt Co. was identified as the lowest responsive responsible alternative bid amount;
 
Whereas, Funds for the project were included in the approved FY 2007 Parks Rehabilitation and Development Millage - Fund 0018 budget; and
 
Whereas, D & H Asphalt Co. received Human Rights approval on September 8, 2008 and complies with the Living Wage and prevailing wage requirements;
 
RESOLVED, That City Council approve a construction contract, per Bid #3970, with D & H Asphalt Co. in the amount of $49,955.50 for Pathway Reconstruction at Mary Beth Doyle Park, a construction contingency in the amount of $4,995.50 (10%) to cover potential contract change orders, and a total construction project budget of $56,199.00 for the life of the project without regard to fiscal year;  
 
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution including the authority to approve change orders within the approved contingency; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the contract after approval as to substance by the City Administrator and approval as to form by the City Attorney.
