Resolution Authorizing Sanitary Sewer Improvement Charges for 2053 Newport Road ($17,877.00)
Memorandum
Your approval is requested to levy the fixed sanitary sewer improvement charge of $17,877.00 on the property known as 2053 Newport Road. In 2005, the owner signed an "Outside City Service Agreement" in order to receive City water services and pay the historical water improvement charge. The owner paid the water connection charges and connected the property to the available City water main. In order to fulfill obligations of that agreement, the owner requested annexation from Ann Arbor Township which was completed on December 27, 2007, as notified by the State of Michigan. Following annexation, the property owner has worked with Community Development to connect the property to the available sanitary sewer main as is required by Code. The applicable connection charges have been paid and the property is "active" for sanitary sewer as of June 11, 2008.
According to current procedures, the property owner needs to now pay the property's share of the existing utilities through the City improvement charge levy as required under section 1:278, Chapter 12, of the Ann Arbor Code. The $17,877.00 Utilities Improvement Charge is to be levied and then made payable in 15 annual installments at 4.983% interest per annum on the unpaid balance.
It is therefore recommended that Council levy this improvement charge according to the terms described above.

Whereas, The owner of 2053 Newport Road is being furnished sanitary sewer;
Whereas, Pursuant to Section 1:278, Chapter 12, of the Code of the City of Ann Arbor, the fair share of the cost of said improvement is levied against certain properties and this fair share has not been previously paid nor contracted for;
RESOLVED,
1. That Council levy an improvement charge against the following annexed property which is specifically benefited by the above improvements:

LOT 4 JENNINGS NEWPORT HEIGHTS; previously Ann Arbor Township and now situated in the City of Ann Arbor, Washtenaw County, Michigan;
2. That the improvement charge levied be $17,877.00;
3. That this improvement charge be divided into 15 equal installments; the first to be due on September 4, 2008, and the 14 subsequent installments to be due on June 1 of each and every year thereafter, with the deferred installments of the improvement charge to bear interest at the rate of 4.983% per annum commencing September 4, 2008;
4. That the Public Services Area be directed to send a copy of this resolution by first class mail to the owners of the property and to promptly have this resolution recorded in the office of the Register of Deeds of Washtenaw County, Michigan; and
5. That this levied improvement charge be invoiced to the owner, Henry Owen, of the property known as 2053 Newport Rd, City of Ann Arbor, Washtenaw County, Michigan 48103, and to be credited in the amount of $17,877.00 to Fund 0043-073-8000-7151.
