Attached for your review and approval is a resolution to authorize a Professional Services Agreement with Midwestern Consulting, LLC (MCI) for design engineering services in the amount of $57,084.21 for the Newport Creek Culvert Crossing at Newport Road.  
 
The purpose of this project is to repair the inlet and outfall of the existing culvert and to stabilize the slope from the existing culvert to Newport Road (see attached Project Location Map).  In recent years, during severe rain events, the embankment on the upstream end of the culvert has been washed out by floodwaters, causing the collapse of a section of Newport Road over the culvert.
 
The Project Management Unit issued a Request for Proposal (RFP #650) for a professional engineering firm to study and design repairs and/or improvements for multiple failing storm sewer outfalls and culverts throughout the City.  In response to our request, we received twenty-three (23) proposals.  A review team composed of City staff evaluated the proposals and selected Midwestern Consulting, LLC for their proposed work plan, staff qualifications, past involvement with similar projects, and competitive fee schedule. MCI has received an updated Human Rights and Living Wage approval on May 16, 2008.  
 
Services to be performed include the required surveying, analysis, design, and permitting for the project, as well as the development of complete construction plans and specifications for the project.  
 
The Newport Creek Culvert Crossing project and its associated funding was approved by Council as a part of the FY09 Capital Budget.  Funding will be advanced from the Storm Water Sewer System Operating Fund balance pending the sale of Stormwater Revenue Bonds.

Whereas, The project is necessary to mitigate the severe erosion that is threatening the structural stability of the section of Newport Road over the existing culvert;
 
Whereas, Proposals were received by Procurement and evaluated by Project Management staff on the basis of qualifications, past involvement with similar projects, proposed work plan, and cost;
 
Whereas, Midwestern Consulting, LLC of Ann Arbor, Michigan has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, Midwestern Consulting, LLC received Human Rights and Living Wage approval on May 16, 2008; and
 
Whereas, The Newport Creek Culvert Crossing project and it's associated funding was approved by Council as a part of the FY09 Capital Budget ;
 
RESOLVED, That a Professional Services Agreement with Midwestern Consulting, LLC in the amount of $57,084.21 be approved for Professional Engineering Services for the Newport Creek Culvert Crossing;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That a contingency amount of $9,000.00 be established within the project budget and that the City Administrator be authorized to approve additional Amendments to the Professional Services Agreement with Midwestern Consulting, LLC, not to exceed $9,000.00 in order to satisfactorily complete this project;
 
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
