An Ordinance to Amend Section 10:148 of Chapter 126 (Traffic Code) of Title X of the Code of the City of Ann Arbor (ORD No. ORD-08-15) - Pedestrian Right of Way in Marked Crosswalks
Memorandum
The attached amendment to Chapter 126 will clarify the rights of pedestrians in un-signalized crosswalks and allow for the usage of the "Yield here to pedestrian" signs in the City of Ann Arbor. The change is recommended in the City of Ann Arbor Non-motorized Transportation Plan and was positively reviewed by the City's Alternative Transportation Committee.

Current Ann Arbor City Code does not provide a local ordinance that specifically requires a driver to yield to a pedestrian at un-signalized crosswalks. The language in the attached amendment has been approved by the City Attorney's Office and will allow the City to install ""Yield here to pedestrian" signs compliant with the Michigan Manual of Uniform Traffic Control Devices.

(PEDESTRIAN RIGHT OF WAY IN MARKED CROSSWALKS)

AN ORDINANCE TO AMEND SECTION 10:148 OF CHAPTER 126 (TRAFFIC) OF TITLE X OF THE CODE OF THE CITY OF ANN ARBOR.

The City of Ann Arbor Ordains:

Section 1. That Section 10:148 of Chapter 126 of Title X of the Code of the City of Ann Arbor be amended to read as follows:

10:148. Pedestrians crossing streets.

(a) No pedestrian shall cross a street at a location other than at a crosswalk into which vehicle traffic is then restricted by a traffic control device unless such crossing may be done safely and without interfering with motor vehicle and bicycle traffic on that street.
