Resolution to Amend Previously Approved Resolution R-347-8-01 Authorizing Water Main Improvement Charge for 1710 Dhu Varren Road ($6,990.65)

Attached for your approval is a resolution amending the water improvement charge amount authorized in the resolution for this property approved on August 20, 2001 (R-347-8-01).
This property annexed October 30, 1998, per the State of Michigan. The property is actively connected to and receiving water utility service. The water main was constructed in 1985. There is a utility service agreement signed by the current owner dated March 30, 1998. The agreement stipulates the water improvement charge amount of $6,990.65. The improvement charge levied was $8,043.75 and incorrectly indicated that the fair share had not been previously contracted. As a result of the contractual agreement for the water improvement charge we are requesting that the water improvement charge be changed to the amount stipulated in the agreement.
The property currently has sanitary sewer available to serve the property and is not yet connected to that utility. We will be providing the property owner with notice to connect to the sanitary sewer as required by Code. A subsequent resolution will be brought before you to levy the sanitary sewer improvement charge at the appropriate time.
So as not to change either the original resolution number assigned or the date of approval, the approval of this resolution will amend only the portion of resolution R-347-8-01 that specifies the amount of the water improvement charge. Your approval of this resolution will allow us to reapply the previous principal and interest payments. Any overpayment will be refunded.
