Resolution to Approve Plymouth Green Crossings Revised Development Agreement, 3391 Plymouth Road
Memorandum
Approval of this resolution will revise paragraph P-27 of the development agreement, which pertains to the affordable housing contribution.  This PUD project requires affordable housing units or a contribution to the City's Affordable Housing Trust Fund in lieu of the units and the petitioner chose to pay the contribution ($315,000).  The development agreement requires the fee to be paid prior to the issuance of the first certificate of occupancy.  The petitioner has proposed paying the fee incrementally, as each certificate of occupancy is requested with each unit.
 
This proposed change has been reviewed and accepted by staff.  The City Attorney's Office has revised the agreement language and the petitioner has acknowledged concurrence with the revised provision.

Whereas, Plymouth Green Crossings LLC has requested that paragraph P-27 of the Plymouth Green Crossings Development Agreement, as approved by City Council on January 23, 2006, be revised; and
 
Whereas, The proposed revisions have been reviewed and determined to be acceptable by City service units;
 
RESOLVED, That City Council approve the Plymouth Green Crossings Revised Development Agreement, substantially in the form of that attached, dated January 22, 2008; and
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to sign the Development Agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney.
