Memorandum
There is a resolution before you to accept an easement for public utilities from CVS 8088 MI, L.L.C., a Delaware limited liability company, for a water main and sanitary sewer.
The easement is in standard form and conveyed without cost to the City.
Acceptance of the easement is recommended.

Whereas, CVS 8088 MI L.L.C., a Delaware limited liability company, is the fee simple owner of property located in the City of Ann Arbor, Washtenaw County, Michigan;
Whereas, A Certificate of Incumbency and Authorization dated October 16, 2007 authorized the delivery of a perpetual easement to the City for the construction and maintenance of public utilities; and
Whereas, CVS 8088 MI, L.L.C., has delivered an easement to the City for public utilities, to run with the land and burden the respective property perpetually, being more particularly described as follows:
A 40 FOOT WIDE WATER MAIN EASEMENT
Commencing at the SW corner of Section 30, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan, thence N 00°27'46" W 855.27 feet along the West line of said Section 30; thence N 75°20'54" E 928.82 feet along the centerline of Liberty Street; thence S 25°09'28" E 473.48 feet along the centerline of West Stadium Boulevard (variable width); thence N 64°50'32" E 40.00 feet to the POINT OF BEGINNING,
thence continuing N 64°50'32" E 35.00 feet;
thence S 25°09'28" E 40.00 feet;
thence S 64°50'32" W 35.00 feet;
thence N 25°09'28" W 40.00 feet along the Northeasterly right-of-way line of said West Stadium Boulevard to the POINT OF BEGINNING. Being subject to easements and restrictions of record, if any.
