Mayor John Hieftje called the regular session of the Ann Arbor City Council to order at 7:10 p.m. in the City Hall Council Chamber.
 
Council stood for a moment of silence.
 
Mayor Hieftje led Council in the recitation of the Pledge of Allegiance.

ANNOUNCEMENT
 
HURRICANE KATRINA
 
Mayor Hieftje announced that the Governor has pledged to federal authorities and FEMA that the City of Ann Arbor would assist in the efforts of the State of Michigan taking in up to 10,000 citizens of the United States who have been displaced by Hurricane Katrina. A meeting was held today to discuss the situation and it was determined that there are approximately 130 housing units for immediate occupancy in the Ann Arbor area.  The McKinley Corporation was very helpful and brought forward 100 units of housing.  Another meeting will take place on September 7, 2005 with different organizations in Ann Arbor to discuss how the City can be more helpful not just with shelter but with schooling, clothing, food, etc.
 
 
INTRODUCTIONS
 
Presentation of the Code RED Emergency Notification System
 
Matt Naud, Environmental Coordinator, gave Council an introduction of the CodeRED Emergency Notification System.  He said that the system is capable of dialing 60,000+ phone numbers to notify people of emergency situations.  The system would be used for emergency purposes only.  An example would be a major water main break in the City where citizens would be advised to boil their water. The system would also be used to inform Police and Fire personnel (all at one time) of any emergency situations that they may need to respond to.
 
Proclamation Honoring the Ann Arbor Downtown Rotary Club
 
Mayor Hieftje, presented a proclamation to the Ann Arbor Downtown Rotary Club Tree Program in recognition of all of their hard work and dedication to restoring Ann Arbor's Trees.  A copy of the proclamation is on file in the City Clerk's office.

PUBLIC HEARINGS
 
Ashley Terrace ZONING (ORDINANCE NO. 29-05)
 
A public hearing was conducted on the proposed amendment to Chapter 55, rezoning of 0.60 acre from C2B/R (Business Service/Residential District) to C2A (Central Business District), Ashley Terrace property, located at 202-212 West Huron Street (Northwest Corner of Huron and Ashley Streets).  Notice of public hearing was published August 21, 2005.
 
Karen Sidney, 100 Longman Lane, said that approval should be delayed to allow time for more public input.
 
Michael Potter, 101 N. Main, #103, spoke in opposition of the proposed Ashley Terrace zoning.
 
Valerie Paladino, 218 N. Division, spoke in support of the proposed Ashley Terrace zoning.
 
Joe Fitzsimmons, 101 N. Main resident, said that he was in favor of more density downtown and had no problem with the proposed Ashley Terrace zoning if the 11th Floor was not built at the current proposed height.
 
Alessandro DiNello, 301 W. Michigan Ave, Jackson, Michigan, representing Flag Star Bank, said that they have worked hard to come up with something that would be satisfying to everyone and stated he was available to answer questions of Council.
 
A representative of Joseph Fried and Associates said that the developers have worked with the residents at 101 N. Main and have agreed to reduce the 11th floor penthouse by four feet.  He was also available to answer any questions of Council.
 
Bill Meyer, representing the petitioner, said that the horizon line view would not be obstructed with the proposed rezoning of this property.
 
There being no further comment, the Mayor declared the hearing closed.
 
 
Ashley Terrace Site Plan
 
A public hearing was conducted on the proposed Ashley Terrace Site Plan, 0.60 acre, located at 202-212 West Huron Street.  Notice of public hearing was published August 28, 2005.

Whereas, The City has been able to improve Safety Services' reporting capabilities and has enabled mobile access to vital information by Safety Services personnel through these applications;
 
Whereas, The City of Ann Arbor is granted the proper license agreement to use, modify, and update the applications;
 
Whereas, The City staff is granted support for problem resolution and general use issues for the applications;
 
Whereas, The City is granted access to all updates and changes to the applications by VisionAIR without additional charges; and
 
Whereas, VisionAIR's received Human Rights and Living Wage compliance approval August 8, 2005;
 
RESOLVED, That City Council approve issuance of a purchase order to VisionAIR, Inc., in the amount $77,960.82 to maintain VisionAIR maintenance agreement; and

Whereas, A development agreement has been prepared to address public and private utilities, park contribution, and street tree planting escrow, construction and maintenance of on-site storm water management system, traffic mitigation, and footing drain disconnections;
 
Whereas, The Ann Arbor City Planning Commission, on June 21, 2005, reviewed said request;
 
Whereas, The contemplated development will comply with all applicable state, local and federal law, ordinances, standards and regulations;
 
Whereas, The development would limit the disturbance of natural features to the minimum necessary to allow a reasonable use of the land, applying criteria for reviewing a natural features statement of impact set forth in Chapter 57; and
 
Whereas, The development would not cause a public or private nuisance and would not have a detrimental effect on the public health, safety or welfare;

Resolution to Annually Update Formula Calculation for a Per-Unit Contribution Amount for Affordable Housing Contributions for Planned Unit Development Districts
 
Whereas, It is the intent of the City Council to promote a full range of housing choices as a part of the Planned Unit Development (PUD) district regulations;
 
Whereas, Section 5:80 of Chapter 55 of the Ann Arbor City Code allows for additional density in a PUD development if affordable housing for lower income households is provided;
 
Whereas, Individual site and economic factors may make the development of on-site affordable housing for lower income households less desirable than providing affordable housing through other means, such as monetary contributions;
 
Whereas, The purpose of the PUD affordable housing contribution is to establish a per-unit amount that would be accepted by City Council in lieu of providing housing units within a PUD;
 
Whereas, The affordable housing contribution is a per-unit payment that serves to offset the difference between the cost to purchase a moderately priced housing unit that is available on the market and the sales price that is affordable to a lower income household; and
 
Whereas, This formula will be prorated for projects of 9 units or less to counteract the high per-unit burden for smaller developments;
 
RESOLVED, That a petitioner for a PUD Zoning District that proposes to provide affordable housing in accordance with the requirements of Section 5:80(2) and 5:80(6)(e) of Chapter 55 of Ann Arbor City Code may request that the City accept an affordable housing contribution in lieu of the required affordable units;
 
RESOLVED, That City Council may approve a request for an affordable housing contribution in lieu of the required PUD units at its sole discretion;
 
RESOLVED, That City Council will use the following formula to determine the per-unit affordable housing contribution for each fiscal year for PUD Zoning Districts where there are 10 or more units:
 
1)      A moderately priced housing unit will be determined by calculating the 20th percentile of all residential property sales (excluding vacant land and commercial property) in the City of Ann Arbor from February, March and April of the previous fiscal year, using public information provided by the City of Ann Arbor Assessor.
 
2)      A sales price that is affordable to a lower income household will be determined by multiplying two (2) times the income of a family of four at 80% Area Median Income (AMI), as published by HUD.
 
3)      The difference between the moderately priced housing unit and a housing unit affordable to a lower income household shall determine the affordable housing contribution for each affordable housing unit that is required in the PUD;
 
RESOLVED, That for FY 2005-2006 the affordable housing contribution for each unit required in the PUD is $61,300.00;
 
RESOLVED, That for PUD Zoning Districts with 1-9 total dwelling units, the affordable housing contribution shall be pro-rated by multiplying the amount of the affordable housing contribution for one dwelling unit by the following:
 
9 units            0.9 of the per-unit amount            $55,170.00;
8 units            0.8 of the per-unit amount            $49,040.00;
7 units       0.7 of the per-unit amount            $42,910.00;
6 units            0.6 of the per-unit amount            $36,780.00;
      5 units            0.5 of the per-unit amount            $30,650.00;
      4 units            0.4 of the per-unit amount            $24,520.00;
      3 units            0.3 of the per-unit amount            $18,390.00;
      2 units            0.2 of the per-unit amount            $12,260.00;

RESOLVED, That PUD affordable housing contributions received by the City shall be deposited in the Affordable Housing Trust fund, to be used to develop affordable housing units in the City;
 
RESOLVED, That City Council will review information provided by the Community Development Unit on an annual basis and may adjust the formula at the start of the fiscal year if necessary; and
 
RESOLVED, That affordable units and/or affordable housing contributions required as part of a PUD Zoning District approval shall be secured through contractual arrangements, restrictive covenants, resale and rental restrictions or other available legal remedies, as determined to be necessary by the City Attorney.

Whereas, It is in the best interests of the City of Ann Arbor to reduce domestic violence;
 
Whereas, The 15th District Court has been awarded a two-year domestic violence prevention grant by the U.S. Department of Justice; and
 
Whereas, The grant terms require the Court to be the lead administrative grant agency;
 
RESOLVED, That City Council authorize the receipt of funds from the 2005 Domestic Violence Prevention Grant from the U.S. Department of Justice and the appropriation of those funds to the 15th District Court for the life of the grant without regard to City Fiscal Year; and
 
RESOLVED, That City Council authorize the Court to establish a separate grant account to receive, hold, disburse and account for funds awarded pursuant to this grant.

Whereas, The 15th District Court is required by law to archive certain records;
 
Whereas, The Court's current static file storage system is over capacity;
 
Whereas, A removable high-density file storage system will increase file storage capacity by 400%, will eliminate the need to lease additional file storage space and can be reused if the Court relocates to another structure;
 
Whereas, The Court has determined that the acquisition and installation of a high-density file storage system is in the best interests of the administration of justice;
 
Whereas, FileTech Systems, Inc. was the low bidder for that system;
 
Whereas, FileTech Systems, Inc. received Living Wage and Contract Compliance approval on July 12, 2005;
 
Whereas, The Court's FY 04/05 budget contained funds allocated from the Court Facility Fund to pay for this acquisition;
 
Whereas, Unavoidable delays have extended acquisition into FY 05/06, and the Court's budgeted FY 04/05 funding has lapsed;
 
RESOLVED, That City Council authorize the amendment of the Court's FY 05/06 budget to allocate $40,000.00 from the Court Facility Fund to the appropriate line item in the Court's FY 05/06 budget; and
 
RESOLVED, That City Council authorize the issuance of a purchase order to FileTech Systems, Inc. in an amount not to exceed $40,000.00 for the acquisition and installation of high-density file system components.

Whereas, The Michigan Department of Environmental Quality requires protection programs for all drinking water sources;
 
Whereas, New information is now available which should be used to update the previous 1997 wellhead protection plan for the Steere Farm wellfield;
 
Whereas, The Michigan Department of Environmental Quality awarded the City of Ann Arbor a Wellhead Protection Grant in the amount of $7,500.00 for FY 05/06; and
 
Whereas, Funds have been budgeted in the FY06 Operations & Maintenance budget of the Water Treatment Unit to provide matching funds;
 
RESOLVED, That the City Council accept the Wellhead Protection Grant in the amount of $7,500.00; and
 
RESOLVED, tThat these grant funds be returned appropriated to the Water Treatment Division Unit, account 0042 073 4000 1000 2100.

Resolution for Approval of a Professional Services Agreement with CDM for the Water Quality Distribution System Monitoring Project and Project Budget
 
Whereas, The Water Quality Distribution System Monitoring Project will enhance and secure the distribution system drinking water quality;
 
Whereas, There is a need for real time continuous monitoring of the water quality in the drinking water distribution system;
 
Whereas, The selection of instrumentation and their optimal location for said monitoring has to be performed;
 
Whereas, The City solicited proposals from engineering firms for said monitoring through RFP No.  1986, Water Quality Distribution System Monitoring Project;
 
Whereas, Of the three firms that submitted proposals, CDM submitted a proposal in the amount of $206,074.00 and was selected as the most qualified firm to provide the services requested in RFP No. 1986;
 
Whereas, CDM's scope of services for this agreement includes selection of instrumentation and their optimal location suitable for the Ann Arbor water supply system; and
 
Whereas, CDM has received Human Rights approval on March 17, 2005, and complies with the Living Wage Ordinance;
 
RESOLVED, That Council accept the proposal and approve the professional services agreement with CDM in the amount of $206,074.00 to provide professional engineering services for the Water Quality Distribution System Monitoring Project;
 
RESOLVED, That Council approve a project budget of $251,474.00 consisting of $206,074.00 for professional engineering services, $25,400.00 for labor provided by City staff, and $20,000.00 for a contingency for change orders to be approved by the City Administrator;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the professional services agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treas. Reg. 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That $251,474.00 available to be appropriated from the future sale of Water Revenue Bonds; for the life of the project until expended without regard to fiscal year.

Resolution Directing the Ann Arbor Environmental Commission to Develop a Commercial Recycling Implementation Plan
 
Whereas, The City of Ann Arbor adopted a Solid Waste Management Plan Update in 2002 that includes an overall recycling diversion goal (including the entire commercial sector) of 60% - approximately 40,200 tons/year for both City serviced and non-City serviced commercial;
Whereas, A key initiative established in the plan update is the development of commercial recycling program with a goal of 50% diversion for commercial recycling by 2007;
Whereas, Increasing commercial waste diversion from the current 22% to at least 50% will require greatly expanded capacity for collection of recyclable and compostable material;
Whereas, Capital replacement and expansion needs at the City's MRF/Transfer facility are underway, building capacity to handle greater quantities of commercial recyclables;
Whereas, There are still many questions that remain to be answered before final choices are made on the strategic options covered in the implementation plan; and
Whereas, discussion on the following items is needed to develop choices about commercial recycling collection infrastructure;
 
      __The feasibility of implementing recycling collection user fees,  
      __The motivation of private businesses to recycle,  
      __The public and private sector roles in system operation,  
      __The role of contracting, franchising and hauler licensing strategies,  
      __The ordinance/rules/regulations that will be needed, and  
      __The technical and procurement steps required for the selected system.
 
resolved, That the Ann Arbor Environmental Commission is charged with developing a Commercial Recycling Plan based on the elements contained in the approved Solid Waste Plan;
Resolved, That City Council establish a multi stakeholder committee under the auspices of the Environmental Commission that includes representatives from the following categories of stakeholders to develop the plan:
 
      __At least 3 Environmental Commissioners;
      __A representative of the Ann Arbor Chamber of Commerce;
      __2 representatives of merchants associations such as the West Stadium Area Business and Professional Association, South University Area Association, or North Campus Plaza Shopping Center;
      __A management representative from a multi-tenant building or shopping plaza or mall;
      __A representative of the Downtown Development Authority, and;
      __Two members of the public that live or work in the City of Ann Arbor.;
 
Resolved, That City Council direct that the Environmental Commission be staffed with expertise in recycling collection and processing to support this planning process; and
 
Resolved, That this plan be completed and forwarded to the City Council by April 2006.
 
Councilmember Teall moved, seconded by Councilmember Easthope that the resolution be adopted.

from the State of Michigan Council for Arts and
Cultural Affairs (MCACA) for the Expansion of
Ann Arbor's Historic Michigan
Theater's Cinema Program
 
Whereas, The State of Michigan Arts and Cultural Affairs (MCACA) provides a Cool Cities Program grant to counties, cities, townships and villages;
 
Whereas,  MCACA's Cool Cities Program supports arts and cultural activities, including capital improvements to arts and cultural facilities;
 
Whereas, MCACA's Cool Cities Program is a matching grant program that provides assistance for expansion of cultural facilities and the purchase of equipment directly related to the arts presenting or producing function of an organization;
 
Whereas, The City, on behalf of Ann Arbor's Michigan Theater (Michigan Theater), applied to MCACA for a grant to enhance the Michigan Theater's programming capabilities through the expansion of the cinema program with three new digital cinema formats and allow the Michigan Theater to become one of the few theaters in the country with high-tech, top-level film and digital projection capability;
 
Whereas, The Michigan Theater has agreed to provide the required matching funds for the grant and complete the necessary grant reports;
 
Whereas, The City Administrator will serve as grant administrator for this project; and
 
Whereas, The City has been advised by MCACA that it has been awarded a grant in the amount of $100,000.00 for the purchase of the digital cinema equipment for the Michigan Theater as requested in the grant;
 
RESOLVED, That the City Council accept the grant funds in the amount of $100,000.00 for the purchase of the digital cinema equipment for the Michigan Theater as requested in the grant;
 
RESOLVED, That City Council appropriate the grant funds when received for the life of the grant without regard to fiscal year;
 
RESOLVED, That the City Administrator be authorized and directed to execute the grant agreement in accordance with the terms of the grant application after approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator be authorized to take all necessary actions to comply with the grant agreement and implement this Resolution.

Resolution Opposing Ensign/Mccain Broadband Investment
and Consumer Choice Act
 
Whereas, Senators John Ensign and John McCain have introduced S. 1504, the Ensign/McCain Broadband Investment and Consumer Choice Act;
 
Whereas, The Proposed legislation would abolish cable franchising, which ensures that the services cable companies provide meet our local needs, provide needed protections for us and the public, and allow these provisions to be changed over time as needs change and technology evolves;
 
Whereas, The proposed legislation would, unlike any other utility service, abolish requirements that cable service be provided wherever in a community there is sufficient population density to make service economic;
 
Whereas, The proposed legislation would relatedly, allow cable companies to "redline" and deny service on the basis of race, sex, senior citizen status;
 
Whereas, The proposed legislation would reduce (perhaps substantially) the cable franchise fees providers pay to use public property;
 
Whereas, The proposed legislation appears to grant video providers the right to use public rights of way in perpetuity, without even the protections that the courts impose when the government condemns property;
 
Whereas, The proposed legislation does not adequately preserve local ability to manage the streets, such as requiring providers to relocate lines at their expense when streets are straightened or widened;
 
 
Whereas, The proposed legislation does not have meaningful provisions on channels for public, educational or governmental use, and lacks provisions in current law requiring the provider to provide funds to support these channels;
 
Whereas, The proposed legislation does not have provisions to protect us or the public if the provider causes damage or goes bankrupt;
 
Whereas, The proposed legislation appears to abolish all zoning of cellular towers, so towers can be put anywhere in a community, without regard to whether they are needed or their effect on property values; and
 
Whereas, The proposed legislation appears to abolish telephone franchises and fees, even though these companies have and should continue to pay "rent" to use the streets, which are public property maintained at great expense, for their lines;
 
RESOLVED, That the Ann Arbor City Council opposes this proposed legislation because of the negative affects on local municipalities and Ann Arbor specifically; and
 
RESOLVED, That the Mayor send the letter on file in the City Clerk's Office to State Senators Levin and Stabenow opposing this proposed legislation.
 
Councilmember Higgins moved, seconded by Councilmember Easthope that the resolution be adopted.

Whereas, The Committee recommends the following allocations:
      
1.)      Ann Arbor Jaycees - $4,000.00, to cover police staffing costs for the 2005 Summer Carnival.
 
2.)      Main Street Area Association - $525.00, to cover police staffing costs for the 2005 Rolling Sculpture Car Show.
 
3.)      Ann Arbor Jaycees - $1,000.00, to cover police staffing charges for the 2005 July 4th Parade.
 
4.)      Main Street Area Association - $100.00, to cover police and barricade costs for the 2005 Rock'n Rollin' Block Party.

RESOLVED, That City Councilmember Joan Lowenstein is designated as Acting Mayor with all powers and responsibilities as stated in Section 4.3 of the Ann Arbor City Charter in the event that both Mayor Hieftje and Mayor Pro Tem Easthope are unable to perform the duties of the office of Mayor in September 2005.
