Memorandum
Attached for your review and approval is a resolution to approve Amendment No. 1 to the Professional Services Agreement with Orchard, Hiltz & McCliment, Inc. (OHM) in the amount of $38,200.00, and amend the project design budget to $310,826.00 for the design of Huron Parkway-Nixon Road Improvement Project.
Orchard, Hiltz & McCliment, Inc. was awarded the design contract for the Huron Parkway-Nixon Road Improvement Project on February 5, 2007 (R-43-2-07) in the amount of $179,626.00 and a project budget of $252,626.00 was established.   A change order for additional public engagement work was awarded on August 14, 2007 in the amount of $15,000.00 for a new total design contract of $194,626.00.
 
The scope of the original contract included a public engagement process in conjunction with the design of a roundabout at the intersection.  Attachment A shows the recommended option which was selected based on a number of criteria including providing a high level of service, low maintenance costs, safe vehicular and pedestrian operation, minimizing the amount of additional easement that City would need to purchase near the intersection, and aesthetics.  The original project design work also included an inspection of Nixon Road south of the intersection.
 
As a result of the Nixon Road inspection, it was determined that Nixon Road should be reconstructed from Huron Parkway to Plymouth Road.  We recommend that the full reconstruction of Nixon Road south of the intersection be added to this project.  The proposed amendment to OHM is for the preparation of the design of this section of Nixon Road for its inclusion with the intersection project.
 
The Huron Parkway-Nixon Road Intersection Improvement Project is included in the City's current and FY09 Capital Improvement Plan (CIP). The funding for the project design is planned from the City's Street Resurfacing Millage capital budget, with the participation from the Federal and State grants for construction.  The design of the project is scheduled to be completed during the winter of 2007/2008 and the construction contract is expected to be led by the Michigan Department of Transportation as a Federal Aid project for construction in 2008.
 
The attached resolution seeks approval of Amendment No. 1 to the Professional Services Agreement with Orchard, Hiltz & McCliment, Inc. ($38,200.00) and amends the Huron Parkway-Nixon Road Improvement Project design budget to include other associated costs ($20,000.00) for the design of the reconstruction of Nixon Road from Huron Parkway to Plymouth Road.  
 
The total project design cost is shown below:

Whereas, On February 5, 2007 the City entered into an agreement with Orchard, Hiltz & McCliment, Inc. in the amount of $179,626.00 for the planning and design of the Huron Parkway - Nixon Road Intersection Improvement Project (R-43-2-07);
 
Whereas, On August 14, 2007 the City approved Change Order No. 1 for the additional work in the area of public engagement in the amount of $15,000.00;
 
Whereas, The design and reconstruction of improvements to Nixon Road from Huron Parkway to Plymouth Road are necessary and should be done in conjunction with the Huron Parkway-Nixon Road intersection work;
 
Whereas, The Huron Parkway-Nixon Road Intersection Improvement Project is included  in the City's Capital Improvements Plan and the Street Millage capital budget;
 
Whereas, It is necessary to retain the services of a professional engineering firm to perform additional design work;
 
Whereas, Orchard, Hiltz & McCliment, Inc. has demonstrated the required experience, qualified professionals, and competitive fee schedule for design of the project; and
 
Whereas, Orchard, Hiltz & McCliment, Inc. received Human Rights approval on May 7, 2007, and complies with the living wage ordinance;
RESOLVED, That City Council authorizes the Amendment to the Professional Services Agreement with Orchard, Hiltz & McCliment, Inc. in the amount of $38,200.00 for the design  of the Nixon Road reconstruction as part of the Huron Parkway - Nixon Road Improvement Project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said amendment, after approval as to form by the City Attorney, and approval as to substance by the City Administrator;
 
RESOLVED, That the project design budget be amended to an amount of $310,826.00;
RESOLVED, That an additional contingency amount of $5,000.00 be established from the project design budget and that the City Administrator is authorized to approve change orders to the professional services agreement with Orchard, Hiltz & McCliment, Inc., not to exceed established contingencies in order to satisfactorily complete the project design; and
 
RESOLVED, That the City Administrator is authorized to take necessary administrative actions to implement this resolution.
