Memorandum

Attached for your consideration is a resolution to approve a contract with CB&I Environmental & Infrastructure, Inc., for Material Recycling Facility (MRF) Contract Development Services. The current contract between the City and ReCommunity for the operation of the City-owned MRF and Transfer Station is a 217-page document that includes ten separate, yet inter-related amendments. There are six years remaining in the term of the contract. The complexity of this contract has become an impediment to the management of this aspect of the City’s solid waste program for both the City and ReCommunity. In addition to the complexity of the contract that has evolved over the duration of the contract, the marketplace for recyclable materials has also evolved over this same period. As a result of these conditions, it is desirable to reexamine the existing business model and contract structure for operating these facilities.

 

The City issued RFP No. 931, which was promoted to environmental consultants, and was posted on BidNet. Two proposals were received; the proposal from CB&I Environmental & Infrastructure, Inc. was found to meet the needs and requirements identified in the RFP, and was selected based on the quality of their work plan and related experience.

 

The contractor will evaluate the current market risks and develop strategies that optimize the financial impact on the operations of the City MRF and Transfer Facility and support sustainable operations. The City is seeking recommendations in revising and streamlining a new contract with current industry best practices/standards. The contractor has provided a work plan that will examine these issues and make recommendations regarding a recommended business model for recycling and transfer station ownership and operation and a clear, concise, and modern model contract.

 

Budget/Fiscal Impact

The proposed contract is $121,780.00 with a contract contingency of ten percent, $12,178.00.  The funding for the contract is available in the approved FY 16 Solid Waste Operations and Maintenance budget.

Whereas, The City seeks recommendations in revising and streamlining a new contract with current industry best practices/standards;

 

Whereas, The City wants to reexamine the existing business model in light of the many changes in the marketplace;

 

Whereas, The CB&I Environmental & Infrastructure, Inc., has been selected to provide these services based on their work plan and fees in response to RFP (Request for Proposal) No. 931;

 

Whereas, CB&I Environmental & Infrastructure, Inc., complies with the City’s non-discrimination and Living Wage Ordinances; and

 

Whereas, Funding for this work is available in the approved the FY16 Solid Waste Fund Operating Budget;

 

RESOLVED, That a City Council approves a contract with CB&I Environmental & Infrastructure, Inc. for Material Recycling Facility Contract Development in the amount of $121,780.00;

 

RESOLVED, That a contingency in the amount of $12,178.00 (10%) be established and that the City Administrator be authorized to approve change orders to the contract with CB & I Environmental & Infrastructure, Inc. in an amount not-to-exceed $133,958.00;

 

RESOLVED, That the funding for the contract and the contingency amount be made available without regard to fiscal year;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute the agreement for services after approval as to substance by the City Administrator and approval as to form by the City Attorney; and

 

RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this resolution, including the authority to approve amendments within the contingency amount.
