Resolution to Release an Existing Public Utilities Easement and Accept in its Place New Water Main Easements at 2725 S. State Street from University of Michigan Credit Union and 2727 S. State from South State Commons III, L.L.C. (8 Votes Required)
Memorandum
In 1996, City Council accepted a grant of easement from Metropolitan Life Insurance Company for public utilities at what is now 2725 and 2727 S. State Street. The existing easement is being released and new easements for water main accepted that better match the property lines and installed facilities. Only water main is and will be installed in the new easements.
These easements are in standard form and conveyed without cost to the City.
Release of the existing public utilities easement and acceptance of the new water main easements are recommended.

Whereas, In 1996, Metropolitan Life Insurance Company granted to the City an easement for public utilities at what is presently 2725 and 2727 S. State Street, recorded at Liber 3352, Page 87 of Deeds, Washtenaw County Records;
Whereas, University of Michigan Credit Union is the current owner of property commonly known as 2725 S. State Street, described at Liber 5074, Page 263 of Deeds, Washtenaw County Records; and
Whereas, University of Michigan Credit Union has signed a grant of easement for water mains and appurtenances, described as:
Commencing at the Southwest corner of Section 4, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan, thence N01°53’00”W 250.00 feet along the West line of said Section; thence N87°09’00”E 51.25 feet; thence N02°03’20”W 614.05 feet along the Easterly right-of-way line of South State Street to the POINT OF BEGINNING: thence continuing N02°03’20”W 40.01 feet along said right-of-way line; thence N87°01’00”E 173.50 feet; thence S02°59’00”E 40.00 feet; thence S87°01’00”W 174.15 feet to the Point of Beginning. Being a part of the Southwest 1/4 of Section 4, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan and containing 6,953 square feet of land, more or less.
Whereas, South State Commons III, L.L.C is the current owner of property commonly known as 2727 S. State Street, described at Liber 4535, Page 731 of Deeds, Washtenaw County Records; and
Whereas, South State Commons III, L.L.C. has signed a grant of easement for water mains and appurtenances, described as:
Commencing at the Southwest corner of Section 4, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan, thence N01°53’00”W 250.00 feet along the West line of said Section; thence N87°09’00”E 51.25 feet; thence N02°03’20”W 614.05 feet along the Easterly right-of-way line of South State Street; thence N87°01’00”E 174.15 feet to the POINT OF BEGINNING: thence N02°59’00”W 40.00 feet; thence N87°01’00”E 95.26 feet; thence N02°59’00”W 212.00 feet; thence N87°01’00”E 49.81 feet; thence N42°01’00”E 36.39 feet; thence S86°17’10”E 8.31 feet; thence S03°42’50”W 40.00 feet; thence N86°17’10”W 39.39 feet; thence S02°59’00”E 201.62 feet; thence N87°01’00”E 27.71 feet; thence S02°59’00”E 40.00 feet; thence S87°01’00”W 162.97 feet to the Point of Beginning. Being a part of the Southwest 1/4 of Section 4, T3S, R6E, City of Ann Arbor, Washtenaw County, Michigan and containing 16,011 square feet of land, more or less.
Whereas, City staff have recommended release of the existing easement for public utilities and acceptance of these replacement easements for water main;
RESOLVED, That the City of Ann Arbor releases all rights under the easement for public utilities recorded at Liber 3352, Page 87 of Deeds, Washtenaw County Records;
RESOLVED, That the City of Ann Arbor accepts the replacement grants of easement for water main from University of Michigan Credit Union and South State Commons III, L.L.C. respectively; and
RESOLVED, That an appropriate instrument, approved by the City Attorney, evidencing this release and replacement be recorded at the Washtenaw County Register of Deeds as soon as practicable following approval of this Resolution.
