Memorandum

Attached for your review and approval is a resolution to authorize an agreement with the Ann Arbor Downtown Development Authority (“DDA”) to participate in design costs for the reconstruction of North Fifth Avenue and Detroit Street.

 

The DDA has a desire to improve the streetscape within the Kerrytown area and approached the City to discuss how to incorporate this work into the City’s upcoming North Fifth Avenue Reconstruction project, which includes road reconstruction, water main replacement, intersection improvements, and stormwater management.  After the discussions, the City and the DDA agreed to the DDA hiring an engineering firm to design the streetscape work in addition to the City’s infrastructure improvements. Because all these design elements impact each other, it was determined to be the best course of action to have all of the design work performed at the same time.  Upon further discussion, the design of Detroit Street within the Kerrytown area was also included in the scope, as many of the same design elements would need to be incorporated from North Fifth Avenue, and public engagement could be performed all at once for this sensitive area.

 

The DDA conducted a formal RFQ process and awarded the contract to the engineering and public engagement team of SmithGroupJJR (“Consultant”).  The Consultant will work closely with the City’s project manager as well as the DDA’s project manager to assure that all elements of the design for the project are synchronized.  Construction for this project is presently scheduled for 2018.

 

Construction cost responsibilities for different portions of the work were discussed in principal with the DDA, and these percentages were used as a base to determine the respective amounts that each party would pay towards the design cost of the project.  The DDA will have the contractual relationship with the Consultant, and the City will reimburse the DDA for its portion of the fees. The attached document outlines the terms of the agreement between the City and the DDA to complete the work described above.

 

Financial Impact

The City’s Capital Improvement Plan includes several projects related to the North Fifth Avenue Project (TR-SC-14-07, UT-ST-16-01, and UT-WS-16-06). As this is a planned project, it will not have any unexpected impact on budget or resources.

Whereas, The City’s Capital Improvement Plan includes several projects related to the North Fifth Avenue Project (TR-SC-14-07, UT-ST-16-01, and UT-WS-16-06);

 

Whereas, The City and the DDA agree it would be beneficial in collaborating on the design of the infrastructure improvements and the streetscape improvements;

 

Whereas, The DDA agreed to solicit an RFQ for a design consultant to which the City provided input into the qualifications required;

 

Whereas, Following the RFQ process and interviews, the City and the DDA selected SmithGroupJJR and their team as the design consultant for the project;

 

Whereas, The City and DDA have drafted the attached cost-sharing agreement for the design phase of the project;

 

Whereas, The DDA will pay all design fees and will invoice the City for its share of the design fees as detailed in the attached Agreement.

 

RESOLVED, That City Council approves the attached Agreement with the Ann Arbor Downtown Development Authority for responsibilities and cost allocations for the design of the North Fifth Avenue Reconstruction Project;

 

RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator; and

 

RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution and to approve amendments to the agreement within the project budget.
