Memorandum

Your approval is requested to amend a Professional Services Agreement in the amount of $86,051.39 with DLZ Michigan, Inc. (DLZ) to provide construction engineering, management and inspection services for construction of the 2015 Wastewater Treatment Plant (WWTP) Access Bridge Repair Project.

 

The purpose of this project is to construct repairs to the access bridge for the City's WWTP.  The bridge is a single lane structure that was first constructed in 1934 and traverses the Huron River to provide access to the plant.  In addition to plant traffic, the bridge also conveys three sanitary sewers and one natural gas line.  The most recent improvements to the bridge were made in 2000 when the deck was overlaid, the railings and guardrails were replaced, the expansion joints were replaced and the substructure was patched.

 

Based on bi-annual inspections since 2000, a major bridge replacement project was anticipated and scheduled for 2017.  However, a thorough inspection performed during 2014 revealed that the bridge has significant metal and concrete corrosion but is in better condition than anticipated.  Implementing the repair project at this time will be more cost efficient and will postpone the need for bridge replacement by extending the life of the existing bridge for another ten to fifteen years with scheduled maintenance.

 

Work to be done under this project includes removal of timber debris upstream of pier, removing and replacing pier diaphragms, partial cleaning and coating of structural steel, chipping and patching of substructure, crack injection of substructure, placing scour countermeasures, cleaning expansion joint, brush and tree removal, and slope restoration.

 

On April 21, 2014, Council approved a contract with DLZ in the amount of $32,752.07 to prepare detailed plans and specifications to repair the access bridge.  On May 4, 2015, the City Administrator approved Amendment No. 1 to the contract with DLZ in the amount of $3,235.21 to provide additional design services related to underwater work including the use of a coffer dam, temporary structural bridge support requirements and addressing environmental impact issues.  Amendment No. 1 was funded from the approved contract contingency but did not cover the entire cost for the additional services provided during the design phase of the project, resulting in a balance of $13,776.00 due to DLZ.

 

Work on the access bridge must be done without impeding vehicular access to the WWTP.  Due to the single lane width of the bridge and the need for uninterrupted vehicular access to the WWTP 24 hours per day, seven days per week, construction activities on the bridge will be restricted to off-hour timeframes.  These time restrictions are especially critical due to the ongoing construction of the Facilities Renovations Project and will lessen the impact of the bridge project on plant access and other construction activities.  Most of the work on the bridge will occur on weekends and between 9:00 p.m. and 5:00 a.m. on weekdays when traffic frequency is at its lowest.  Work under the bridge and on the piers will be permitted during normal business hours provided that the contractor does not restrict vehicular access.

 

At the City's request, DLZ provided a proposal to provide construction engineering, management and inspection services during construction of this project.  DLZ is the best choice for providing these services considering that they prepared the construction plans and specifications and are highly qualified and experienced in this type of work.  The proposed fees submitted by DLZ reflect the additional cost for off-hour construction inspection services and includes $13,776.00 for the additional design services provided previously.  WWTP staff reviewed the proposed services and fees and found them reasonable, especially considering the nature of the underwater work and off-hour construction schedule.

 

DLZ received contract compliance approval on April 14, 2015, and complies with the City's living wage, nondiscrimination and Conflict of Interest requirements.  The standard Amendment to an Agreement for Professional Services without modifications will be used for this amendment between the City and DLZ.

 

You are requested to approve Amendment No. 2 with DLZ in the amount of $86,051.39 with a contingency of $8,600.00 to finance future amendments necessary to complete the project.  Further, you are requested to authorize the City Administrator to approve future amendments up to the amount of the contingency.  Funds to finance this project are available in the approved Sanitary Sewer Fund Capital Budget.

Whereas, DLZ Michigan, Inc. (DLZ) was selected to provide construction engineering, management and inspection services for this project because they prepared the construction plans and specifications for this project and are highly qualified and experienced in this type of work;

 

Whereas, DLZ complies with the requirements of the nondiscrimination and living wage ordinances, and submitted a Conflict of Interest declaration to the City Procurement Unit and received contract compliance approval on April 14, 2015;

 

Whereas, Funding for the additional design services provided in the amount of $13,776.00 is available in the approved Sanitary Sewer fund operation and maintenance budget; and

 

Whereas, Funding for the construction engineering, management and inspection services for this project are included in the approved Sanitary Sewer Capital Budget;

 

RESOLVED, That Council approve Amendment No. 2 to the Professional Services Agreement with DLZ for $86,051.39 to provide construction engineering, management and inspection services to construct the 2015 WWTP Access Bridge Repair Project;

 

RESOLVED, That Council approve a contingency of $8,600.00 to address additional services that may be needed;

 

RESOLVED, That Council authorize the City Administrator to approve amendments to the Agreement up to the amount of the contingency;

 

RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for the costs of the Project with proceeds of Bonds; and

 

RESOLVED, That the Mayor and City Clerk be authorized to execute the amendment after approval as to substance by the City Administrator and approval as to form by the City Attorney.
