Resolution to Accept an Easement for Sanitary Sewer at 2460 Prairie Court from Beverly A. Tucker (8 Votes Required)

Memorandum

This easement was requested by Richard and Elsa Stuber to allow them to construct a public sewer over Ms. Tucker's property to serve the Stubers' property to the north at 2940 Bluett Drive. In addition to granting the City its standard sanitary sewer easement, this easement also grants the Stubers the right to construct a sewer in the easement provided the sewer is built to City standards, with City approval, and is conveyed to the City. The Stubers' right expires in 5 years, after which the easement would continue as a standard City easement.

 

Acceptance of the easement is recommended.

Whereas, Richard and Elsa Stuber have requested that the City accept an easement for sanitary sewer from Beverly A. Tucker to permit them to construct public sanitary sewer across Ms. Tucker's property at 2460 Prairie Court to their property at 2940 Bluett Drive;

 

Whereas, Beverly A. Tucker is the owner of property commonly known as 2460 Prairie Court, Ann Arbor, Michigan, described at Liber 1712, Page 864, Washtenaw County Records; and

 

Whereas, Beverly A. Tucker has signed a grant of easement for sanitary sewer and appurtenances described as follows:

 

Commencing at the Northeast corner of Lot 126, “NORTH CAMPUS HEIGHTS NO. 3” as recorded in Liber 16 of Plats, Pages 29 and 30, Washtenaw County Records; thence S87°57’47”W 56.54 feet along the North line of said Lot to the POINT OF BEGINNING; thence S36°53’26”E 62.70 feet; thence S57°02’40”W 96.07; thence Westerly along the Northerly right-of-way line of Prairie Court 38.24 feet along the arc of a 50.00 foot radius nontangential circular curve to the left, through a central angle of 43°49’00”, having a chord that bears N69°26’22”W 37.31 feet; thence N57°02’40”E 86.12 feet; thence N36°53’26”W 51.46 feet; thence N87°57’47”E 36.56 feet along the North line of said Lot 126 to the Point of Beginning. Being a part of Lots 125 and 126, “NORTH CAMPUS HEIGHTS NO. 3”, a subdivision of part of the Southeast 1/4 of Section 15, T2S, R6E, City of Ann Arbor, Washtenaw County, Michigan as recorded in Liber 16 of Plats, Pages 29 and 30, Washtenaw County Records and containing 4355 square feet of land, more or less. Being subject to easements and restrictions of record, if any.

 RESOLVED, That the City of Ann Arbor accept this grant of easement.
