Resolution to Approve the Closing of Fourth Avenue from Catherine to Kingsley on Monday, June 29th and on Tuesday, June 30th
Memorandum
Attached for your consideration is a request from the Jim Toy Community Center to close Fourth Avenue from Catherine to Kingsley on June 29th in anticipation of a decision of the Supreme Court on the case of DeBoer vs. Snyder.  In the event that this decision is not announced on June 29th, the Jim Toy Foundation wants to close that same block of Fourth Ave. on June 30th, the last day of the current session of the Supreme Court.
Any decision made by the Supreme Court on this issue will be significant.  The plaintiffs and their attorneys plan to be at Braun Court on June 29th and respond to the announcement of the decision; local, state and national press are also expected to be present.  If the announcement occurs on June 30th, plaintiffs, their attorneys and the press will return to Braun Court.
The Supreme Court announces its decisions in the morning.  The sponsor requests that the street be closed between 9 am and 3 pm to provide ample time for those who attend the announcement to respond to any questions from the press.  If the announcement does not occur on the 29th, the street can be opened by 12 pm.
 
The sponsor agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, to comply with all City regulations governing the use of the street and will reimburse the City for all event expenses.

Whereas, The City received a request from the Jim Toy Community Center to close Fourth Avenue from Catherine to Kingsley on Monday, June 29th, 2015 and June 30th from 9:00 AM until 3 pm for the announcement of the Supreme Court decision in the DeBoer v Snyder case;
Whereas, The street closure will be properly signed, barricaded and supervised by the sponsor;
Whereas, The sponsor agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, to comply with all City regulations governing the use of the street and will reimburse the City for all event expenses; and
Whereas, Impacted businesses and residents will be notified of the event in advance, alerting them to the possible dates of the street closure through flyers, print and social media and again on the day of the event (because the date is not certain);
RESOLVED, That City Council approve the closing of Fourth Avenue from Catherine to Kingsley from 9:00 AM until 3 pm on June 29th and June 30th, 2015; and
 
RESOLVED, That the City Council further waives all fees for barricades.  The Jim Toy Community Center shall obtain all permits required and pay any and all other related fees/expenses in connection with holding the Event.
