Memorandum
This easement is for highway purposes for a portion of the existing M-14 bridge over the Huron River near the Main Street and Barton Drive exits. The bridge crosses over Bandemer Park and Barton Drive in this area. This easement fills in a gap in the existing MDOT highway right-of-way and confirms the prior and existing use of the area for highway purposes. No new construction is being conducted and no change in the highway is proposed. This easement was requested in conjunction with bridge maintenance activities by MDOT.
 
The easement is in a form provided by MDOT and has been reviewed and approved by the City Attorney's Office, Parks and Recreation Services, and Public Services Area. No compensation is attached to this easement.
 
Approval of this easement is recommended.

Whereas, The Michigan Department of Transportation has requested an easement to confirm prior and existing highway bridge access over Bandemer Park and Barton Drive; and
 
Whereas, The appropriate City service areas have reviewed the request and recommend approval of the grant of easement;
 
RESOLVED, That the City of Ann Arbor approve the grant of easement over the following premises:
 
That part of Section 17, Town 2 South, Range 6 East, City of Ann Arbor, Washtenaw County, Michigan, lying Southwesterly of Silver Stream Drive, and Lot 8 and Lot 7 of Long Shore Park, a part of Section 17, City of Ann Arbor, Washtenaw County, Michigan; and lying Northeasterly of a line described as: Commencing at the South 1/4 corner of Section 17, Town 2 South, Range 6 East; thence North 88 degrees 25'34" East, along the South line of said Section 17 a distance of 1270.72 feet to the legal alignment of Highway M-14; thence North 28 degrees 23'24" East, along said alignment 0.95 feet; thence Northeasterly, along a curve to the left 737.80 feet, said curve having a radius of 20217.65 feet, a central angle of 2 degrees 05'27", and a chord of 737.75 feet, bearing North 27 degrees 20'40" East; thence South 78 degrees 41'51" East, 129.38 feet to the point of beginning of said line; thence North 78 degrees 41'51" West, 238.70 feet; thence North 66 degrees 35'32" West, 19.45 feet to the point of ending of said line; and lying 125.00 feet (measured at right angles) each side of a line described as: Commencing at the South 1/4 corner of Section 17, Town 2 South, Range 6 East; thence North 88 degrees 25'34" East, along the South line of said Section 17 a distance of 1270.72 feet to the legal alignment of Highway M-14; thence North 28 degrees 23'24" East, along said alignment 0.95 feet; thence Northeasterly, continuing along said alignment and along a curve to the left 639.82 feet, said curve having a radius of 20217.65 feet, a central angle of 1 degrees 48'48", and a chord of 639.79 feet, bearing North 27 degrees 29'00" East to the point of beginning of said line; thence Northeasterly, along a curve to the left 600.00 feet, said curve having a radius of 20217.65 feet, a central angle of 1 degree 42'01", and a chord of 599.98 feet, bearing North 25 degrees 43'35" East to the point of ending of said line.
 
The lands described above in easement contain 2.14 acres, more or less.
 
The easement described above is subject to the following easement reservation:
 
An easement reservation for roadway and public park purposes, being 125.00 feet each side of a line described as: That part of Section 17, Town 2 South, Range 6 East, City of Ann Arbor, Washtenaw County, Michigan; commencing at the South 1/4 corner of Section 17, Town 2 South, Range 6 East; thence North 88 degrees 25'34" East, along the South line of said Section 17 a distance of 1270.72 feet to the legal alignment of Highway M-14; thence North 28 degrees 23'24" East, along said alignment 0.95 feet; thence Northeasterly, continuing along said alignment and along a curve to the left 1054.56 feet, said curve having a radius of 20217.65 feet, a central angle of 2 degrees 59'19", and a chord of 1054.44 feet, bearing North 26 degrees 53'45" East to the point of beginning of said line; thence Southwesterly along said curve 225.72 feet, said curve having a radius of 20217.65 feet, a central angle of 0 degrees 38'23", and a chord of 225.72 feet, bearing South 25 degrees 43'22" West, to the point of ending of said line.
 
The lands described above in said easement reservation is intended to be inclusive of the land lying Northeasterly of the water's edge of the Huron River and contains approximately 1.068 acres, more or less.
 
The above bearings and distances are relative to the Michigan State Plane Coordinates, South Zone (2113). Please note that the method of expressing the bearings in the description is reflective of reference to the Michigan State Plane grid location for North. The distances expressed are relative to the state plane grid distance.
 
RESOLVED, That the Mayor and City Clerk be authorized to execute the grant of easement in a form approved by the City Attorney.
