Memorandum
Attached for your review and consideration, please find a resolution to approve a contract agreement between the City of Ann Arbor and the Michigan Department of Transportation (MDOT) for the construction phase of pedestrian crossing safety improvements on Ann Arbor-Saline Road between W. Oakbrook Drive and S. Main Street.  The agreement defines the cost sharing of the construction, as well as each party's rights and responsibilities, and is required for the project to receive its share of federal funding from the Highway Safety Improvement Program (HSIP).
 
The current City of Ann Arbor Capital Improvements Plan includes project TR-AT-16-01, which involves the construction of the two separate pedestrian crossings on Ann Arbor-Saline Road.  The southerly crossing is approximately 320 feet north of W Oakbrook Drive, and the northerly crossing is approximately 1450 feet south of S. Main Street. Work to be performed at each location includes the construction of concrete islands, curb and gutter, sidewalks and ADA ramps, the installation of rectangular rapid flashing beacons (RRFB's) and solar powered street lights, the placement of pavement markings, and the restoration of disturbed areas. During construction, a minimum of one lane of vehicular traffic will be maintained in each direction along Ann Arbor-Saline Road. Pedestrian traffic will be detoured along Ann Arbor-Saline Road opposite the side where work is being performed.
 
Completed plans were submitted to MDOT in March of 2015, and the project was advertised in May for the June 5, 2015, MDOT bid letting.  This memorandum and resolution were prepared prior to the letting date so bid results were not available.  MDOT will award a contract to the qualified low bidder and administer the contract.  The City will act as the project engineer.
 
Construction is expected to begin by mid-July and be complete by mid-August, 2015.
 
Budget/Fiscal Impact
 
The estimated total cost of the project is $168,500.00.  In total, the City will be receiving $75,060.00 in federal funds for this project, which will be applied toward a portion of participating construction expenses.  The City will be funding the reminder of the construction costs, the design and construction engineering, and construction material testing costs from the Street Reconstruction Millage. The project is included in the approved FY16 Capital Improvement Plan.

The average annual cost to maintain each crossing is estimated at $3,500.00/year.  This includes an estimated $1,750.00 for snow removal, $1,100.00 for solar battery replacements, and $650.00 for routine preventative maintenance of the RRFB's and street lights.
 
A requirement for this type of project is that the City enters into a contract agreement with the State of Michigan stipulating the funding split and other rights and responsibilities of either party.  Based on estimated project costs Highway Safety Improvement Program (HSIP) Funds are expected to pay for 66% of the construction costs eligible for participation.  These funds are capped at $75,060.00.

Whereas, Funding for this project is available in the approved Street Reconstruction Millage capital budget;
 
Whereas, The City of Ann Arbor will receive federal funding from the Highway Safety Improvement Program (HSIP); and
 
Whereas, It is necessary to approve the cost sharing agreement with the Michigan Department of Transportation so that the project can proceed;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute Michigan Department of Transportation Contract No. 15-5221 for the Ann Arbor-Saline Road Pedestrian Crossing Safety Improvements Project, substantially in the form on file with the City Clerk, following approval as to substance by the City Administrator, and approval as to form by the City Attorney; and
 
RESOLVED, That Council authorizes the City Administrator to take the necessary administrative actions to implement this resolution.
