Resolution to Approve the Closing of State Street from Monroe to Packard for the Slide the City Event on July 4, 2015

Memorandum

Attached for your consideration is a request from the sponsor, Slide the City, to close State Street from Monroe to Packard for the Slide the City event on July 4, 2015 from 4:00 AM until midnight. The actual event will start at approximately 11:00 AM and end at approximately 6:00 PM. The additional time will be used for set-up and take-down for the event.

 

Slide the City is a family fun day with the main attraction being a 1,000 foot water slide through the City. The timing of the event is such that this will be an added activity to the events already taking place on the 4th of July which include the Jaycees annual 4th of July Parade and the Firecracker 5K, which already close State Street from Washington to Monroe from 7:00 AM until 1:00 PM. There will be music and announcements beginning after 11:00 AM and ending at 6:00 PM. All impacted businesses and residents will be notified via flyers, print and social media, the City’s website and GovDelivery. The applicant is working closely with the State Street and South University Street Associations.

 

The applicant has provided a “Slide the City 2015 Health Department Document” to describe how the water is used. As this is a new and very different event, the applicant will be available for questions at the City Council meeting. 

 

The sponsor agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, to comply with all City regulations governing the use of the street and will reimburse the City for all event expenses.

Whereas, The City received a request from Slide the City to close State Street from Monroe to Packard on Saturday, July 4, 015 from 4:00 AM until midnight for the Slide the City event;

 

Whereas, The street closure will be properly signed, barricaded and supervised by the sponsor;

 

Whereas, The sponsor agrees to obtain all necessary permits, to provide evidence of proper liability insurance as required, to comply with all City regulations governing the use of the street and will reimburse the City for all event expenses; and

 

Whereas, Impacted businesses and residents will be notified of the event at least two weeks prior to the event through the City’s website, GovDelivery, flyers, print and social media;

 

RESOLVED, That City Council approve the closing of State Street from Monroe to Packard from 4:00 AM until midnight on July 4, 2015 subject to the following conditions being met:

 

1.                     Slide the City shall obtain all permits required and pay any and all related fees/expenses in connection with holding the Event

2.                     Slide the City shall indemnify and hold the City harmless from all suits, claims, and expense resulting or alleged to result from acts or omissions by Slide The City, its employees and agents, occurring in connections with the Event.

3.                     Slide the City shall procure such insurance policies as will protect itself and the City from any and all claims for injury or damage in connection with the Event in types and amounts satisfactory to the City Attorney. Insurance coverage shall be primary and non-contributory. The City shall be named as an additional insured on the general liability policy. Evidence of insurance coverage and endorsement shall be satisfactory to the City Attorney.

4.                     The City shall be an included party in any waiver or release of claims signed by participants.
